HOUSE BILL NO. 412

AN ACT PROPOSING AN AMENDMENT TO ARTICLE II OF THE CONSTITUTION OF THE STATE OF DELAWARE RELATING TO OPEN MEETINGS AND PUBLIC RECORDS OF THE GENERAL ASSEMBLY.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):


Section 1.Amend Article II of the Constitution of the State of Delaware by adding a new section to read as follows:

§ 26.Open meetings and access to public records.

Each House of the General Assembly, all committees, including joint committees, subcommittees, task forces, or other similar entities created by the House of Representatives or Senate, or both, and all public records thereof shall be open to the public, subject to exceptions and reasonable regulations that shall be determined by appropriate legislation.Such legislation shall be binding on all future General Assemblies.Ethics committees and caucuses shall not be subject to this section.".


SYNOPSIS

This is the first leg of a constitutional amendment that requires the General Assembly to have meetings and public records open to the public.

As a constitutional amendment, future General Assemblies will be subject to open meeting and open public record laws.
