HOUSE CONCURRENT RESOLUTION NO. 2

COMMEMORATING JANUARY 22ND, 2023 AS THE 50TH ANNIVERSARY OF THE UNITED STATES SUPREME COURT RULING IN ROE V. WADE

WHEREAS, on January 22, 1973, the U.S. Supreme Court agreed in a 7-2 vote that the Due Process Clause of the Fourteenth Amendment provided pregnant individuals with a right to have an abortion; and

WHEREAS, this Supreme Court, led by the Honorable Chief Justice Warren Burger, posited that the right to privacy is not absolute but must be balanced in protecting the life of the individual’s health and the fetus; and

WHEREAS, an individual’s ability to access reproductive health care is critical to their physical, psychological, and socioeconomic well-being; and

WHEREAS, low-income people, people of color, young people, and others continue to face obstacles to abortion care; and

WHEREAS, when a person has the ability to end an unwanted pregnancy, they have more time to establish stable relationships, complete education, and secure financial footing; and

WHEREAS, the 149 th General Assembly codified the protections established by Roe v. Wade into law, ensuring continued access to necessary reproductive health care services for all Delawareans by recognizing abortion as an essential human right; and

WHEREAS, January 22, 2023 is the 50 th anniversary of the United States Supreme Court ruling in the case of Roe v. Wade that affirmed the constitutional right to abortion; and

WHEREAS, while the United States Supreme Court abandoned 50 years of precedent with the issuance of the Dobbs v. Jackson decision , Delaware continues to uphold the spirit of Roe by tirelessly working to expand and protect an individual’ access to these critical healthcare services.

NOW, THEREFORE:

BE IT RESOLVED, that the House of Representatives of the 152 nd General Assembly commemorates the 50 th anniversary of the United States Supreme Court decision in Roe v. Wade .
