HOUSE RESOLUTION NO. 25 |
ESTABLISHING A TASK FORCE TO EXAMINE THE ISSUE OF MANUFACTURED HOUSING DELINQUENT TAXES. |
WHEREAS, many manufactured home owners in each of Delaware's three counties have been delinquent in paying county and school taxes to the county in which they reside; and
WHEREAS, the amount owed to each of the three counties in county and school taxes is significant; and
WHEREAS, in New Castle County, manufactured home owners owe a total of $1.5 million in back taxes; and
WHEREAS, manufactured home owners in Kent County owe a total of $1.5 million in back taxes; and
WHEREAS, manufactured home owners in Sussex County owe a total of $2.1 million; and
WHEREAS,totaling all three, more than $5.1 million in unpaid taxes is owed to New Castle, Kent and Sussex Counties and the State; and
WHEREAS, manufactured homes in Delaware are deemed titled property pursuant to the Delaware Code, making the issue of enforcement of property tax delinquency uniquely complicated and one that requires additional research and deliberation; and
WHEREAS, it is not the intent of this resolution to place an undue hardship on manufactured home owners in arrears by displacing them from their residence; and
WHEREAS, it is the intent of this resolution to allow for a plan to be devised in order for the counties and the school districts to continue providing the services and education that all residents, including manufactured home owners, deserve and are entitled to receive;
NOW, THEREFORE:
BE IT RESOLVED by the House of Representatives of the 146th General Assembly of the State of Delaware that a task force be created for the purpose of examining and resolving the issue of delinquent taxes owed to Delaware's three counties by manufactured home owners.
BE IT FURTHER RESOLVED that the task force, as part of its duties, will consider a mechanism by which payment for the delinquent taxes owed to the counties can be retrieved in a fair, legal and equitable manner.
BE IT FURTHER RESOLVED that the task force shall consist of the following members:
(1) one (1) representative from the House Democratic caucus of the Delaware General Assembly;
(2) one (1) representative from the House Republican caucus of the Delaware General Assembly;
(3) the New Castle County Executive or his or her representative;
(4) the Kent County Administrator or his or her representative;
(5) the Sussex County Administrator or his or her representative;
(6) the President of the Delaware Manufactured Home Owners Association or his or her representative;
(7) the Executive Director of the First State Manufactured Housing Association or his or her representative;
(8) the Executive Director of Motor Vehicles or his or her representative;
(9) the Executive Director of the Delaware Association of School Administrators or his or her representative;and
(10) the Executive Director of the Delaware Association of Counties or his or her representative.
BE IT FURTHER RESOLVED that the task force shall select a Chairperson from among its members.
BE IT FURTHER RESOLVED that the task force shall submit a report containing its recommendations to the members of the Delaware General Assembly by no later than March 1, 2012.
