AN ACT TO AMEND TITLE 13 OF THE DELAWARE CODE RELATING TO CHILD SUPPORT. |
Section 1.Amend §2212 of Title 13 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
§2212 Financial institution data matches.
(e) For purposes of this section, "financial
institution" has the meaning given such term by 42 U.S.C. §669a(d)(1). The term "account" means a demand
deposit account, checking or NOW account, savings account, time deposit account,
or money-market mutual fund account. , or voluntary
public and private retirement fund account.
SYNOPSIS
Over the past several years, the federal government and states have begun to place liens on retirement accounts held by noncustodial parents who owe past due child support. This Bill will amend the Delaware Code to include public and private retirement fund accounts by including them in the definition of "account."Only those accounts that are created and funded voluntarily are included in the definition, thus excluding certain pension and state retirement accounts. |
