AN ACT PROPOSING AN AMENDMENT TO ARTICLE VII OF THE DELAWARE CONSTITUTION RELATING TO THE DEATH PENALTY. |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF
THE STATE OF
Section 1.Amend Section 1, Article VII of the Delaware Constitution by adding to the first paragraph thereof as follows:
"Notwithstanding the above limitations, the Governor shall have the absolute power to commute a sentence of death to a sentence of life imprisonment without possibility of probation or parole."
SYNOPSIS
This 1st Leg of a Constitutional Amendment would grant the Governor the power to commute a death sentence to a sentence of life imprisonment without possibility of probation or parole.Currently a majority of the Board of Pardons must first recommend such a commutation. |
