SENATE BILL NO. 192 |
AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO MOTOR VEHICLE SAFETY- RESPONSIBILITY. |
Section 1.Amend Section 2901 of Title 21 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
§2901 Motor vehicles exempted.
This chapter shall not apply with respect to any motor
vehicle owned by the United States, this State or any political subdivision of
this State or any municipality therein or with respect to any motor vehicle
which is subject to the requirements of §§6101 and 6102 of this title.;
however, §2904 of this chapter shall apply to motor vehicles owned by this
State.
SYNOPSIS
This Bill respectfully responds and reacts to the well-reasoned decision in the matter State of Delaware Insurance Coverage Office v. Rabrinda Choudry and Debjani Choudry, C.A. No. N12A-08-003 RRC and codifies the longstanding position of the State of Delaware that it is a self-insurer within the scope of 21 Del. C. §2904.Specifically, this Bill is intended to restore the State's participation in Insurance Commissioner's Arbitrations with respect to certain of its subrogation actions as required by 29 Del. C. § 2118(g)(3). |
