DELAWARE STATE SENATE

147th GENERAL ASSEMBLY

SENATE BILL NO. 227

AN ACT TO AUTHORIZE AND APPROVE THE TRANSFER OF CERTAIN REAL PROPERTY IN THE CITY OF MILFORD TO THE CITY OF MILFORD.



WHEREAS, the Milford Armory, formerly occupied by the Delaware National Guard and located in Milford Delaware has been vacated and turned over to the State; and

WHEREAS, the City of Milford has an interest in acquiring the Armory.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fourths of all members elected to each house thereof concurring therein):

Section 1.The transfer and conveyance of that certain parcel of land and all structures situated thereof, known as the Milford Armory (‘the property") to the City of Milford for the consideration of one dollar ($1.00), is hereby specifically approved, notwithstanding (1) any provisions of Chapter 94, Title 29 of the Delaware Code; or (2) any provisions of any other laws or regulations to the contrary.

Section 2.The Office of Management and Budget, Division of Facilities Management, or other appropriate State agency, is hereby authorized and empowered to execute and deliver to the City of Milford a good and sufficient deed to transfer all property interests in said real property.

Section 3.The City of Milford agrees to accept the property in "as is" condition at the time of conveyance.

Section 4.The property cannot be subsequently sold, or in any way transferred to any other person, corporation or association or used for a non-public purpose without further legislative approval.


SYNOPSIS

This legislation transfers ownership of the Milford Armory to the City of Milford.The legislation states that the property is turned over to the City of Milford in an "as is" condition.Any future transfer or non-public use of the property by the City of Milford requires legislative approval
