DELAWARE STATE SENATE

SENATE BILL NO. 38

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO BICYCLE AND MOTOR VEHICLE SAFETY.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):


Section 1.Amend Section 4116, Title 21 of the Delaware Code in the first sentence by deleting the words "overtaking and passing of vehicles proceeding" and substituting in lieu thereof the words "overtaking and passing of vehicles and bicycles proceeding".

Section 2. Amend Section 4116, Title 21 of the Delaware Code by creating a new subsection (3) thereof, to read as follows:

"(3) The driver of a motor vehicle, when approaching a bicyclist traveling in the same direction, shall ensure the safety and protection of the bicyclist by leaving a reasonable and prudent distance between the vehicle and the bicycle. A three-foot (3') passing distance between the motor vehicle and the overtaken bicycle shall be deemed to be reasonable and prudent. When impossible to achieve the three-foot (3') passing distance, then the driver of the motor vehicle shall reduce its speed to not less than ten (10) miles per hour below the posted speed limit, before attempting to pass to the left of the bicycle."


SYNOPSIS

This bill would create a safe-passing zone between a motor vehicle and a bicycle, when the motor vehicle is overtaking a bicycle traveling in the same direction. If a three-foot-wide passing space is not possible, then the driver of the motor vehicle is to slow down to increase the margin for passing safely beyond the bicycle. This bill is supported by the Delaware Bicycle Council, and is based on similar legislation in Rhode Island.
