DELAWARE STATE SENATE

SENATE BILL NO. 93

AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO AUTOMOBILE CLUBS.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend �908A, Title 18, Delaware Code, by inserting the following at the end of the section:

"This definition does not include an entity that enters into a service contract with an automobile club licensed under this chapter for the provision of emergency road service and towing service to the entity's customers."

SYNOPSIS

This bill clarifies that any third party that contracts with autoclubs for services, such as towing, are not captured in the definition ofsuch under the insurance code.
