DELAWARE STATE SENATE
152nd GENERAL ASSEMBLY
SENATE CONCURRENT RESOLUTION NO. 175
ESTABLISHING THE PROBATION SYSTEM TASK FORCE.
WHEREAS, during the 152 nd General Assembly the Senate and House of Representatives have been examining the current state of the probation system in this State.
NOW, THEREFORE:
BE IT RESOLVED by the Senate of the 152nd General Assembly of the State of Delaware, the House of Representatives concurring therein, that the Probation System Task Force (“Task Force”) is established to study the current state of the probation system in this State and make findings and recommendations.
BE IT FURTHER RESOLVED that the Task Force be composed of the following members, or a designee selected by a member serving by virtue of position:
(1) Two members of the Senate appointed by the President Pro Tempore of the Senate with 1 from the Senate Majority Caucus and 1 from the Senate Minority Caucus.
(2) Two members of the House of Representatives appointed by the Speaker of the House of Representatives with 1 from the House of Representatives Majority Caucus and 1 from the House of Representatives Minority Caucus.
(3) The Chief Justice.
(4) The Attorney General.
(5) The Chief Defender.
(6) The Commissioner of the Department of Correction.
(7) Two individuals who are employed to provide services for individuals who are sentenced to probation in this State, 1 appointed by the President Pro Tempore of the Senate and 1 appointed by the Speaker of the House of Representatives.
(8) Four individuals who are serving or have served a term of probation in this State, 2 appointed by the President Pro Tempore of the Senate and 2 appointed by the Speaker of the House of Representatives.
(9) One individual who is employed by or volunteers for a domestic violence advocacy group in this State, appointed by the President Pro Tempore of the Senate.
(10) One individual who is employed by or volunteers for a probation advocacy group in this State, appointed by the Speaker of the House of Representatives.
BE IT FURTHER RESOLVED that the member of the Senate appointed by the President Pro Tempore of the Senate is the Chair of the Task Force and the member of the House of Representatives appointed by the Speaker of the House of Representatives is the Vice Chair.
BE IT FURTHER RESOLVED that members serving by virtue of position who are granted the ability to designate another individual to attend a Task Force meeting must provide the designation in writing to the Chair. An individual attending a meeting for a member serving by virtue of position has the same duties and rights as the member serving by virtue of position.
BE IT FURTHER RESOLVED that on final passage of this Concurrent Resolution the Secretary of the Senate notify members of the Task Force serving by virtue of position of their selection to serve on the Task Force and notify individuals authorized to appoint members to the Task Force of their appointing authority.
BE IT FURTHER RESOLVED that the Chair of the Task Force be responsible for guiding the administration of the Task Force by, at a minimum, doing all of the following:
(1) Setting a date, time, and place for the initial organizational meeting.
(2) Supervising the preparation and distribution of Task Force meeting notices, agendas, minutes, correspondence, and reports.
(3) Sending a list of the members of the Task Force and, if applicable, the person who appointed the members to the President Pro Tempore of the Senate, the Speaker of the House of Representatives, and the Director of the Division of Research of Legislative Council, after the first meeting of the Task Force.
(4) Providing meeting notices, agendas, and minutes to the Director of the Division of Research of Legislative Council.
(5) Compiling a final report no later than July 1, 2025, containing a summary of the Task Force’s work regarding the issues assigned to the Task Force under this Concurrent Resolution, including any findings and recommendations.
(6) Ensuring that the final report of the Task Force is submitted to the President Pro Tempore of the Senate and the Speaker of the House of Representatives, with copies to all members of the General Assembly, the Governor, the Director and the Librarian of the Division of Research of Legislative Council, and the Delaware Public Archives.
BE IT FURTHER RESOLVED that the Task Force must hold its first meeting not later than September 27, 2024.
BE IT FURTHER RESOLVED that a quorum of the Task Force is a majority of its members.
BE IT FURTHER RESOLVED that:
(1) Official action by the Task Force, including making findings and recommendations, requires the approval of a quorum of the Task Force.
(2) The Task Force may adopt rules necessary for its operation. If the Task Force does not adopt rules or if the adopted rules do not govern a given situation, Mason’s Manual of Legislative Procedure controls.
BE IT FURTHER RESOLVED that the Senate Majority Caucus and Division of Research are responsible for providing reasonable and necessary support staff and materials for the Task Force, as requested by the Task Force.
SYNOPSIS
This Senate Concurrent Resolution establishes the Probation System Task Force to study the probation system and make findings and recommendations.
