150th GENERAL ASSEMBLY
SENATE RESOLUTION NO. 11
DIRECTING THE DEPARTMENT OF CORRECTION TO FURTHER EXPAND TRANSITIONAL SERVICES TO JUSTICE-INVOLVED INDIVIDUALS WITH SUBSTANCE USE DISORDER.
WHEREAS, the majority of people in Delaware correctional facilities return to the community;
WHEREAS, people in the criminal justice system are disproportionately affected by opioid use disorder and other health conditions;
WHEREAS, people with opioid use disorder are at a high risk for a reoccurrence of use, overdose, and potential death upon reentry;
WHEREAS, Delaware does not currently have a systematic approach to ensuring that people with opioid use disorder and other health conditions are systematically connected to care upon release;
NOW THEREFORE:
BE IT RESOLVED by the Senate of the 150 th General Assembly of the State of Delaware that the Division of Medicaid and Medical Assistance and the Department of Correction are encouraged to further their work to ensure Delaware becomes a suspension versus termination state.
BE IT FURTHER RESOLVED that the Division of Medicaid and Medical Assistance and the Department of Correction should collaborate in developing a reentry process that facilitates seamless connections to opioid use disorder treatment and other necessary services upon release.
BE IT FURTHER RESOLVED that the Division of Medicaid and Medical Assistance and the Department of Correction ensure that all eligible individuals without coverage apply for benefits prior to release, which include applying for coverage, selecting a specific managed care organization, and signing a consent form to allow medical information to be shared amongst the Department of Correction, Division of Medicaid and Medical Assistance, the selected manage care organization, and future clinicians.
BE IT FURTHER RESOLVED that the Department of Correction should develop a definition for and a process of identifying people with high health needs, including people with opioid use disorder and other substance use disorders.
BE IT FURTHER RESOLVED that the Division of Medicaid and Medical Assistance and the Department of Correction amend state contracts with managed care organizations to include a process of notifying managed care organizations that an individual who is about to enroll in their plan is to be released from incarceration and identifying those enrollees with high health needs.
BE IT FURTHER RESOLVED that the managed care organization, in concert with the Department of Correction, be required to contact high needs individuals, prior to release, to develop a personalized care plan, which includes any necessary evidence-based treatment for opioid use disorder and other health conditions and referrals for any other community and support services that individuals may need.
BE IT FURTHER RESOLVED that quarterly reports be submitted by the Department of Correction to the Division of Medicaid and Medical Assistance regarding the health utilization of high needs individuals and other such critical indicators determined by the Department of Correction.
SYNOPSIS
This resolution encourages the Division of Medicaid and Medical Assistance and the Department of Correction to facilitate continuous health coverage for individuals with opioid use disorder, other substance use disorders, or high health needs upon release.
