Florida Senate - 2014 COMMITTEE AMENDMENT Bill No. CS for CS for SB 242 Ì171494<Î171494 LEGISLATIVE ACTION Senate . House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— (Simmons) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 242 - 246 4 and insert: 5 (12) The Department of Agriculture and Consumer Services 6 shall investigate any complaints received concerning violations 7 of this section. If, after investigating any complaint, the 8 department finds that there has been a violation of this 9 section, the department may bring an action to impose an 10 administrative penalty. A consumer reporting agency that 11 willfully fails to comply with any requirement imposed under 12 this section is subject to an administrative penalty in the 13 amount of $500 for each violation, imposed by the department. An 14 administrative proceeding that could result in the entry of an 15 order imposing an administrative penalty must be conducted in 16 accordance with chapter 120. The administrative penalty shall be 17 deposited in the General Inspection Trust Fund. 18 19 ================= T I T L E A M E N D M E N T ================ 20 And the title is amended as follows: 21 Delete lines 30 - 31 22 and insert: 23 violates a security freeze; requiring the Department 24 of Agriculture and Consumer Services to investigate 25 complaints regarding the violation of a security 26 freeze; providing penalties and civil remedies for the 27 violation of a security freeze; providing written 28 disclosure
