       Senator Margolis moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 29 - 47
    4  and insert:
    5  775.083.
    6         (b) A person who violates this section by purchasing,
    7  using, offering for use, or possessing powdered alcohol commits
    8  a noncriminal violation, punishable by a fine of $250.
    9         (5) This section does not apply to the use of powdered
   10  alcohol for research purposes by a:
   11         (a) Health care provider that operates primarily for the
   12  purpose of conducting scientific research;
   13         (b) State institution;
   14         (c) State university or private college or university; or
   15         (d) Pharmaceutical or biotechnology company.
   16         (6) This section does not apply to the possession of
   17  powdered alcohol solely for the purpose of transportation
   18  through this state by a licensed manufacturer or a common
   19  carrier on behalf of a licensed manufacturer.
   20         (7) This section expires July 1, 2017.
