Florida Senate - 2022 COMMITTEE AMENDMENT Bill No. SB 1120 Ì398718SÎ398718 LEGISLATIVE ACTION Senate . House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Children, Families, and Elder Affairs (Book) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Before line 23 4 insert: 5 Section 1. Paragraphs (m) and (n) are added to subsection 6 (34) of section 39.01, Florida Statutes, to read: 7 39.01 Definitions.—When used in this chapter, unless the 8 context otherwise requires: 9 (34) “Harm” to a child’s health or welfare can occur when 10 any person: 11 (m) Violates s. 316.613 or s. 316.614, resulting in the 12 death of a child or the injury of a child which requires 13 treatment at a medical facility, if substantiated by a licensed 14 physician’s opinion that the violation exacerbated the child’s 15 injuries or resulted in the child’s death. 16 (n) Violates s. 316.6135, resulting in the death of a child 17 or the injury of a child. 18 Section 2. Paragraphs (j), (k), and (l) are added to 19 subsection (4) of section 39.303, Florida Statutes, to read: 20 39.303 Child Protection Teams and sexual abuse treatment 21 programs; services; eligible cases.— 22 (4) The child abuse, abandonment, and neglect reports that 23 must be referred by the department to Child Protection Teams of 24 the Department of Health for an assessment and other appropriate 25 available support services as set forth in subsection (3) must 26 include cases involving: 27 (j) A child who was not properly restrained in a motor 28 vehicle pursuant to s. 316.613 or s. 316.614, and the improper 29 restraint exacerbated the child’s injuries or resulted in the 30 child’s death. 31 (k) A child who was left unattended or unsupervised in a 32 motor vehicle pursuant to s. 316.6135, and such action resulted 33 in an injury to the child or in the child’s death. 34 (l) Reports from emergency room physicians. 35 36 ================= T I T L E A M E N D M E N T ================ 37 And the title is amended as follows: 38 Delete line 2 39 and insert: 40 An act relating to child welfare; amending s. 39.01, 41 F.S.; expanding the list of incidents that constitute 42 harm to a child’s health or welfare; amending s. 43 39.303, F.S.; expanding the list of child abuse, 44 abandonment, and neglect reports that the Department 45 of Children and Families must refer to Child 46 Protection Teams of the Department of Health; amending 47 s. 39.407,
