Floor: WD . 04/30/2014 10:26 AM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Smith moved the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 1484 and 1485 4 insert: 5 Section 25. Subsection (3) of section 338.26, Florida 6 Statutes, is amended to read: 7 338.26 Alligator Alley toll road.— 8 (3)(a) Fees generated from tolls shall be deposited in the 9 State Transportation Trust Fund and shall be used:, and any10amount of funds generated annually in excess of that required11 1. To reimburse outstanding contractual obligations;,12 2. To operate and maintain the highway and toll facilities, 13 including reconstruction and restoration;,14 3. To pay for those projects that are funded with Alligator 15 Alley toll revenues and that are contained in the 1993-1994 16 adopted work program or the 1994-1995 tentative work program 17 submitted to the Legislature on February 22, 1994;,and18 4. To designdevelopand constructoperatea fire station 19 at mile marker 63 on Alligator Alley, which may be used by a 20 county or another local governmental entity to provide fire, 21 rescue, and emergency management services to the public on 22adjacent countiesalongAlligator Alley; and 23 5. By interlocal agreement effective July 1, 2014, through 24 no later than June 30, 2018, to reimburse a county or another 25 local governmental entity for the direct actual costs of 26 operating the fire stations between mile markers 34 and 35 and 27 at mile marker 63 on Alligator Alley. 28 (b) Funds generated annually in excess of those required to 29 pay the expenses in paragraph (a),may be transferred to the 30 Everglades Fund of the South Florida Water Management District. 31 The South Florida Water Management District shall deposit funds 32 for projects undertaken pursuant to s. 373.4592 in the 33 Everglades Trust Fund pursuant to s. 373.45926(4)(a). Any funds 34 remaining in the Everglades Fund may be used for environmental 35 projects to restore the natural values of the Everglades, 36 subject to compliance with any applicable federal laws and 37 regulations. Projects mustshallbe limited to: 38 1.(a)Highway redesign to allow for improved sheet flow of 39 water across the southern Everglades. 40 2.(b)Water conveyance projects to enable more water 41 resources to reach Florida Bay to replenish marine estuary 42 functions. 43 3.(c)Engineering design plans for wastewater treatment 44 facilities as recommended in the Water Quality Protection 45 Program Document for the Florida Keys National Marine Sanctuary. 46 4.(d)Acquisition of lands to move STA 3/4 out of the Toe 47 of the Boot, provided such lands are located within 1 mile of 48 the northern border of STA 3/4. 49 5.(e)Other Everglades Construction Projects as described 50 in the February 15, 1994, conceptual design document. 51 52 ================= T I T L E A M E N D M E N T ================ 53 And the title is amended as follows: 54 Delete line 154 55 and insert: 56 analysis of a proposed lease; amending s. 338.26, 57 F.S.; revising the uses of fees generated from 58 Alligator Alley tolls to include the cost of design 59 and construction of a fire station that may be used by 60 certain local governments; providing reimbursement for 61 certain counties or other local governmental entities 62 for the direct actual operating costs of certain fire 63 stations; authorizing excess tolls, after payment of 64 certain expenses, to be transferred to the Everglades 65 Trust Fund; amending s. 339.175,
