       Senator Garcia moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 3939 and 3940
    4  insert:
    5         Section 61. Section 338.166, Florida Statutes, is amended
    6  to read
    7         338.166 High-occupancy toll lanes or express lanes.—
    8         (1) Under s. 11, Art. VII of the State Constitution, the
    9  department may request the Division of Bond Finance to issue
   10  bonds secured by toll revenues collected on high-occupancy toll
   11  lanes or express lanes established on facilities owned by the
   12  department.
   13         (2) The department may continue to collect the toll on the
   14  high-occupancy toll lanes or express lanes after the discharge
   15  of any bond indebtedness related to such project. All tolls so
   16  collected shall first be used to pay the annual cost of the
   17  operation, maintenance, and improvement of the high-occupancy
   18  toll lanes or express lanes project within the county where the
   19  tolls were generated. or associated transportation system.
   20         (3) Any remaining toll revenue from the high-occupancy toll
   21  lanes or express lanes shall be used by the department for the
   22  construction, maintenance, or improvement of any road on the
   23  State Highway System within the county or counties in which the
   24  toll revenues were collected or to support express bus service
   25  on the facility where the toll revenues were collected.
   26         (4) The department may implement variable rate tolls on
   27  high-occupancy toll lanes or express lanes.
   28         (5) Except for high-occupancy toll lanes or express lanes,
   29  tolls may not be charged for use of an interstate highway where
   30  tolls were not charged as of July 1, 1997.
   31         (6) This section does not apply to the turnpike system as
   32  defined under the Florida Turnpike Enterprise Law.
