12 | renourishment or restoration; providing limitations for |
13 | purposes of determining state matching funds; exempting |
14 | the state from specified liability provisions with respect |
15 | to parks within the state park system that have free- |
16 | roaming animal populations; designating Jack Mashburn |
17 | Marina in Bay County; directing the Department of |
18 | Environmental Protection to erect suitable markers; |
19 | providing an effective date. |

21 | Be It Enacted by the Legislature of the State of Florida: |
22 | |
23 | Section 1. Subsection (3) of section 258.0145, Florida |
24 | Statutes, is amended, and subsection (4) is added to that |
25 | section, to read: |
26 | 258.0145 Military state park fee discounts.-The Division |
27 | of Recreation and Parks shall provide the following discounts on |
28 | park fees to persons who present written documentation |
29 | satisfactory to the division which evidences their eligibility |
30 | for the discounts: |
31 | (3) Surviving spouses and parents of deceased members of |
32 | the United States Armed Forces, National Guard, or reserve |
33 | components thereof who have fallen in combat shall receive |
34 | lifetime family annual entrance passes at no charge. |
35 | (4) The surviving spouse and parents of a law enforcement |
36 | officer, as defined in s. 943.10(1), or a firefighter, as |
37 | defined in s. 633.30(1), who has died in the line of duty shall |
38 | receive lifetime family annual entrance passes at no charge. |
39 | Section 2. Section 380.0685, Florida Statutes, is amended |
40 | to read: |
41 | 380.0685 State park in area of critical state concern in |
42 | county which creates land authority; surcharge on admission and |
43 | overnight occupancy.-The Department of Environmental Protection |
44 | shall impose and collect a surcharge of 50 cents per person per |
45 | day, or $5 per annual family auto entrance permit, on admission |
46 | to all state parks in areas of critical state concern located in |
47 | a county which creates a land authority pursuant to s. |
48 | 380.0663(1), and a surcharge of $2.50 per night per campsite, |
49 | cabin, or other overnight recreational occupancy unit in state |
50 | parks in areas of critical state concern located in a county |
51 | which creates a land authority pursuant to s. 380.0663(1); |
52 | however, no surcharge shall be imposed or collected under this |
53 | section for overnight use by nonprofit groups of organized group |
54 | camps, primitive camping areas, or other facilities intended |
55 | primarily for organized group use. Such surcharges shall be |
56 | imposed within 90 days after any county creating a land |
57 | authority notifies the Department of Environmental Protection |
58 | that the land authority has been created. The proceeds from such |
59 | surcharges, less a collection fee that shall be kept by the |
60 | Department of Environmental Protection for the actual cost of |
61 | collection, not to exceed 2 percent, shall be transmitted to the |
62 | land authority of the county from which the revenue was |
63 | generated. Such funds shall be used to purchase property in the |
64 | area or areas of critical state concern in the county from which |
65 | the revenue was generated. An amount not to exceed 10 percent |
66 | may be used for administration and other costs incident to such |
67 | purchases. However, the proceeds of the surcharges imposed and |
68 | collected pursuant to this section in a state park or parks |
69 | located wholly within a municipality, less the costs of |
70 | collection as provided herein, shall be transmitted to that |
71 | municipality for use by the municipality for land acquisition or |
72 | for beach renourishment or restoration, including, but not |
73 | limited to, costs associated with any design, permitting, |
74 | monitoring, and mitigation of such work, as well as the work |
75 | itself. However, these funds may not be included in any |
76 | calculation used for providing state matching funds for local |
77 | contributions for beach renourishment or restoration. The |
78 | surcharges levied under this section shall remain imposed as |
79 | long as the land authority is in existence. |
80 | Section 3. The state is exempt from the provisions of s. |
81 | 588.15, Florida Statutes, with respect to any property within |
82 | the state park system that has free-roaming animal populations. |
83 | Section 4. Jack Mashburn Marina designated; Department of |
84 | Environmental Protection to erect suitable markers.- |
85 | (1) The marina commonly referred to as the "boat basin" on |
86 | Grand Lagoon at St. Andrews State Park in Bay County is |
87 | designated as "Jack Mashburn Marina." |
88 | (2) The Department of Environmental Protection is directed |
89 | to erect suitable markers designating Jack Mashburn Marina as |
90 | described in subsection (1). |
91 | Section 5. This act shall take effect July 1, 2011. |
