HB 221

1	A bill to be entitled
2	An act relating to trust funds; creating the Sustainable
3	and Renewable Energy Policy Trust Fund within the Florida
4	Energy Office of the Department of Environmental
5	Protection; providing for sources of funds and purposes;
6	providing for annual carryforward of funds; providing for
7	the future review and termination or re-creation of the
8	trust fund; providing a contingent effective date.

10	Be It Enacted by the Legislature of the State of Florida:
11
12	Section 1.  (1)  The Sustainable and Renewable Energy
13	Policy Trust Fund is created within the Florida Energy Office of
14	the Department of Environmental Protection. The trust fund shall
15	be administered by the head of the office or his or her
16	designee. Funds allocated to the trust fund include funds
17	received from state appropriations, federal and state grants,
18	and deposits consisting of the monthly service charge collected
19	by the electric utilities in the state from every residential,
20	commercial, and industrial consumer of electric service. The
21	funds in the trust fund shall be used to support the activities
22	of the direct-support organization of the office relating to
23	sustainable and renewable energy projects in this state.
24	(2)  Notwithstanding s. 216.301, Florida Statutes, and
25	pursuant to s. 216.351, Florida Statutes, any balance in the
26	trust fund at the end of any fiscal year shall remain in the
27	trust fund and shall be available for carrying out the purposes
28	of the trust fund.
29	(3)  In accordance with s. 19(f)(2), Article III of the
30	State Constitution, the Sustainable and Renewable Energy Policy
31	Trust Fund shall, unless terminated sooner, be terminated on
32	July 1, 2015. Before its scheduled termination, the trust fund
33	shall be reviewed as provided in s. 215.3206(1) and (2), Florida
34	Statutes.
35	Section 2.  This act shall take effect on the same date
36	that House Bill 219 or similar legislation takes effect, if such
37	legislation is adopted in the same legislative session or an
38	extension thereof and becomes law.
