A bill to be entitled
2An act relating to video voyeurism; amending s.
3810.145, F.S.; increasing the penalty to a felony of
4the third degree for conducting video voyeurism in a
5residential dwelling; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Present subsection (9) of section 810.145,
10Florida Statutes, is renumbered as subsection (10), a new
11subsection (9) is added, and subsection (6) of that section is
12amended, to read:
13     810.145  Video voyeurism.-
14     (6)  Except as provided in subsections (7), (8), and
15(9)(8), a person who violates this section commits a misdemeanor
16of the first degree, punishable as provided in s. 775.082 or s.
17775.083.
18     (9)  A person who commits the offense of video voyeurism
19within a residential dwelling commits a felony of the third
20degree, punishable as provided in s. 775.082, s. 775.083, or s.
21775.084.
22     (10)(9)  For purposes of this section, a person has
23previously been convicted of or adjudicated delinquent for a
24violation of this section if the violation resulted in a
25conviction that was sentenced separately, or an adjudication of
26delinquency entered separately, prior to the current offense.
27     Section 2.  This act shall take effect July 1, 2012.
