1	A bill to be entitled
2	An act relating to the Division of Emergency Management;
3	transferring the Division of Emergency Management from the
4	Department of Community Affairs to the Executive Office of
5	the Governor by a type one transfer; creating s. 14.2012,
6	F.S.; establishing the Division of Emergency Management
7	within the Executive Office of the Governor; amending s.
8	20.18, F.S.; conforming provisions to changes made by the
9	act; providing an effective date.

11	Be It Enacted by the Legislature of the State of Florida:
12
13	Section 1.  All powers, duties, functions, records,
14	offices, personnel, property, pending issues and existing
15	contracts, administrative authority, administrative rules, and
16	unexpended balances of appropriations, allocations, and other
17	funds of the Division of Emergency Management within the
18	Department of Community Affairs are transferred by a type one
19	transfer, as defined in s. 20.06(1), Florida Statutes, to the
20	Executive Office of the Governor.
21	Section 2.  Section 14.2012, Florida Statutes, is created
22	to read:
23	14.2012  Division of Emergency Management.-The director of
24	the division shall be appointed by and shall serve at the
25	pleasure of the Governor. The division shall enter into a
26	service agreement for professional, technological, and
27	administrative support services. The division shall collaborate
28	and coordinate with the Department of Community Affairs on
29	nonemergency response matters, including, but not limited to,
30	disaster recovery programs, grant programs, mitigation programs,
31	and emergency matters related to comprehensive plans.
32	Section 3.  Subsection (2) of section 20.18, Florida
33	Statutes, is amended to read:
34	20.18  Department of Community Affairs.-There is created a
35	Department of Community Affairs.
36	(2)  The following units of the Department of Community
37	Affairs are established:
38	(a)  Division of Emergency Management. The division is a
39	separate budget entity and is not subject to control,
40	supervision, or direction by the Department of Community Affairs
41	in any manner including, but not limited to, personnel,
42	purchasing, transactions involving personal property, and
43	budgetary matters. The division director shall be appointed by
44	the Governor, shall serve at the pleasure of the Governor, and
45	shall be the agency head of the division for all purposes. The
46	division shall enter into a service agreement with the
47	department for professional, technological, and administrative
48	support services. The division shall collaborate and coordinate
49	with the department on nonemergency response matters, including,
50	but not limited to, disaster recovery programs, grant programs,
51	mitigation programs, and emergency matters related to
52	comprehensive plans.
53	(a)(b)  Division of Housing and Community Development.
54	(b)(c)  Division of Community Planning.
55	Section 4.  This act shall take effect July 1, 2011.
