A bill to be entitled
2An act relating to an environmental surcharge on
3bottled water; establishing a surcharge on bottled
4water sold at retail in this state; providing an
5exception; requiring that moneys collected from the
6surcharge be deposited into the Ecosystem Management
7and Restoration Trust Fund; providing an effective
8date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  (1)  An environmental surcharge is imposed on
13each bottle of water sold in the amount of 6 percent of the sale
14price of each item, article, or group of items of or containing
15bottled water when sold at retail in this state. The surcharge
16does not apply to water bottled in 1 gallon containers or
17larger.
18     (2)  All moneys collected from the surcharge levied under
19this section shall be deposited into the Ecosystem Management
20and Restoration Trust Fund within the Department of
21Environmental Protection.
22     (3)  The surcharge levied under this section shall be
23administered, collected, and enforced in the same manner as the
24tax imposed under s. 212.05, Florida Statutes.
25     Section 2.  This act shall take effect October 1, 2012.
