A bill to be entitled
2An act relating to citrus canker eradication; repealing s.
3581.1845, F.S., relating to the citrus canker eradication
4program and the payment of compensation to eligible
5homeowners whose citrus trees have been removed under the
6program; amending s. 215.22, F.S.; deleting an exemption
7from a service charge imposed on income of a revenue
8nature deposited in trust funds for funds held for the
9payment of citrus canker eradication and compensation to
10conform; amending s. 933.02, F.S.; deleting a cross-
11reference to conform; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Section 581.1845, Florida Statutes, is
16repealed.
17 Section 2. Paragraphs (i) through (w) of subsection (1) of
18section 215.22, Florida Statutes, are redesignated as paragraphs
19(h) through (v), respectively, and present paragraph (h) of that
20subsection is amended to read:
21 215.22 Certain income and certain trust funds exempt.-
22 (1) The following income of a revenue nature or the
23following trust funds shall be exempt from the appropriation
24required by s. 215.20(1):
25 (h) Funds held for the payment of citrus canker
26eradication and compensation.
27 Section 3. Paragraph (d) of subsection (4) of section
28933.02, Florida Statutes, is amended to read:
29 933.02 Grounds for issuance of search warrant.-Upon proper
30affidavits being made, a search warrant may be issued under the
31provisions of this chapter upon any of the following grounds:
32 (4) When any property is being held or possessed:
33 (d) In violation of the laws relative to citrus disease
34pursuant to s. ss. 581.184 and 581.1845; or

36This section also applies to any papers or documents used as a
37means of or in aid of the commission of any offense against the
38laws of the state.
39 Section 4. This act shall take effect July 1, 2010.
