| 5 | coverage by ch. 838, F.S.; providing an effective date. |

| 7 | Be It Enacted by the Legislature of the State of Florida: |
| 8 | |
| 9 | Section 1. Subsection (6) of section 838.014, Florida |
| 10 | Statutes, is amended to read: |
| 11 | 838.014 Definitions.-As used in this chapter, the term: |
| 12 | (6) "Public servant" means: |
| 13 | (a) Any officer or employee of a state, county, municipal, |
| 14 | or special district agency or entity; |
| 15 | (b) Any legislative or judicial officer or employee; |
| 16 | (c) Any person, except a witness, who acts as a general or |
| 17 | special magistrate, receiver, auditor, arbitrator, umpire, |
| 18 | referee, consultant, agent, or hearing officer while performing |
| 19 | a governmental function; or |
| 20 | (d) A candidate for election or appointment to any of the |
| 21 | positions listed in this subsection, or an individual who has |
| 22 | been elected to, but has yet to officially assume the |
| 23 | responsibilities of, public office. |
| 24 | Section 2. This act shall take effect July 1, 2010. |
