HB 7043

1	A bill to be entitled
2	An act relating to trust funds; re-creating and renaming
3	the Operations Trust Fund within the Department of
4	Revenue; repealing s. 215.198(3), F.S.; abrogating
5	provisions relating to the termination of the trust fund,
6	to conform; providing an effective date.

8	WHEREAS, the Legislature wishes to extend the life of the
9	Operations Trust Fund within the Department of Revenue, which is
10	otherwise scheduled to be terminated pursuant to constitutional
11	mandate, and
12	WHEREAS, the Legislature has reviewed the trust fund before
13	its scheduled termination date and has found that it continues
14	to meet an important public purpose, and
15	WHEREAS, the Legislature has found that existing public
16	policy concerning the trust fund sets adequate parameters for
17	its use, NOW, THEREFORE,

19	Be It Enacted by the Legislature of the State of Florida:
20
21	Section 1.  The Operations Trust Fund within the Department
22	of Revenue, FLAIR number 73-2-510, which is to be terminated
23	pursuant to Section 19(f), Article III of the State Constitution
24	on July 1, 2012, is re-created and renamed the Operating Trust
25	Fund.
26	Section 2.  Subsection (3) of section 215.198, Florida
27	Statutes, is repealed.
28	Section 3.  This act shall take effect July 1, 2011.
