Florida Senate - 2016 SB 118 By Senator Hutson 6-00220-16 2016118__ 1 A bill to be entitled 2 An act relating to persons subject to final 3 deportation orders; creating s. 877.28, F.S.; 4 prohibiting the presence within the state of persons 5 subject to final deportation orders unless such orders 6 have been stayed pending judicial review; providing 7 criminal penalties; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 877.28, Florida Statutes, is created to 12 read: 13 877.28 Presence in state after final deportation order.—A 14 person who knowingly is present in the state after an order of 15 deportation, as defined in 8 U.S.C. s. 1101(47), has become 16 final as described in 8 U.S.C. s. 1101(47)(B), and the order is 17 not stayed pending judicial review, may not be present in this 18 state. A person who violates this section commits a felony of 19 the first degree, punishable as provided in s. 775.082, s. 20 775.083, or s. 775.084. 21 Section 2. This act shall take effect October 1, 2016.
