Florida Senate - 2011 SB 128 By Senator Bullard 39-00180-11 2011128__ 1 A bill to be entitled 2 An act relating to public printing; amending s. 3 283.31, F.S.; revising the record requirements for 4 agency publications; requiring the record to include 5 the reasons for printing and distributing a 6 publication and whether the publication is available 7 electronically; requiring such justification to be 8 included in the agency’s legislative budget request; 9 providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Section 283.31, Florida Statutes, is amended to 14 read: 15 283.31 Records of executive agency publications.—Each 16 agency shall maintain a record of any publication, as defined in17s.257.05, the printing of which costs in excess of the 18 threshold amount provided in s. 287.017 for CATEGORY THREE, at 19 least part of which is paid for by state funds appropriated by 20 the Legislature. 21 (1) TheSuchrecord mustshallalso containthe following: 22written justification of the need for such publication,23 (a) The purpose and need for theof suchpublication.,24 (b) The legislative or administrative authority for the 25 publication.,26 (c) Written justification for printing and distributing 27 printed copies of the publication and whether the publication is 28 also available electronically. Such justification must be 29 included in the agency’s legislative budget request submitted 30 pursuant to s. 216.023. 31 (d) The sources of funding for printing and distributing 32 the publication.,33 (e) The number of printed copies of the publication and, if 34 applicable, the frequency and number of issues., and35 (f) The reasons for deciding to have the publication 36 printed in-house, by another agency or the Legislature, or 37 purchased on bid. In addition, such record mustshallcontain 38 the comparative costs of alternative printing methods ifwhen39 such costs were a factor in deciding upon a method. 40 (2) The record of the corporation operating the 41 correctional industry printing program mustshallinclude the 42 cost of materials used, the cost of labor, the cost of overhead, 43 the amount of profit made by the corporation for such printing, 44 and whether the state agencies that contract with the 45 corporation for printing are prudently determining the price 46 paid for such printing. 47 Section 2. This act shall take effect July 1, 2011.
