Florida Senate - 2022 SB 158 By Senator Harrell 25-00323-22 2022158__ 1 A bill to be entitled 2 An act relating to traveling across county lines with 3 intent to commit a felony; amending s. 843.22, F.S.; 4 defining the term “felony offense”; providing for 5 reclassification of certain felony offenses when the 6 person who commits the offense crosses a county line 7 with specified intent; removing the requirement for 8 reclassification that an offender’s travel be for the 9 purpose of thwarting law enforcement attempts to track 10 stolen items; providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 843.22, Florida Statutes, is amended to 15 read: 16 843.22 Traveling across county lines with intent to commit 17 a felonyburglary.— 18 (1) As used in this section, the term: 19 (a) “County of residence” means the county within this 20 state in which a person resides. Evidence of a person’s county 21 of residence includes, but is not limited to: 22 1. The address on a person’s driver license or state 23 identification card; 24 2. Records of real property or mobile home ownership; 25 3. Records of a lease agreement for residential property; 26 4. The county in which a person’s motor vehicle is 27 registered; 28 5. The county in which a person is enrolled in an 29 educational institution; and 30 6. The county in which a person is employed. 31 (b) “Felony offense” means a felony violation of any of the 32 following: 33 1.“Burglary,” means burglaryas defined in s. 810.02.,34 2. Grand theft, as prohibited under s. 812.014. 35 36 For purposes of this paragraph, the term includesincludingan 37 attempt, solicitation, or conspiracy to commit such offense. 38 (2) If a person who commits a felony offenseburglary39 travels any distance with the intent to commit the felony 40 offenseburglaryin a county in this state other than the 41 person’s county of residence, the degree of the felony offense 42burglaryshall be reclassified to the next higher degreeif the43purpose of the person’s travel is to thwart law enforcement44attempts to track the items stolen in the burglary. For purposes 45 of sentencing under chapter 921 and determining incentive gain 46 time eligibility under chapter 944, a felony offenseburglary47 that is reclassified under this section is ranked one level 48 above the ranking specified in s. 921.0022 or s. 921.0023 for 49 the felony offenseburglarycommitted. 50 Section 2. This act shall take effect October 1, 2022.
