Florida Senate - 2011 CS for CS for SB 236 By the Committees on Budget Subcommittee on General Government Appropriations; and Environmental Preservation and Conservation; and Senators Hays, Detert, Jones, and Altman 601-04494-11 2011236c2 1 A bill to be entitled 2 An act relating to state parks; amending s. 258.0145, 3 F.S.; providing for the parents of certain deceased 4 veterans and the spouse and parents of law enforcement 5 officers and firefighters who die in the line of duty 6 to receive annual entrance passes to state parks at no 7 charge; designating the Jack Mashburn Marina at St. 8 Andrews State Park in Bay County; directing the 9 Department of Environmental Protection to erect 10 suitable markers; exempting parks within the state 11 park system which have free-roaming animal populations 12 from the liability provisions in s. 588.15, F.S.; 13 amending s. 380.0685, F.S., relating to a surcharge 14 imposed on admission fees to state parks in areas of 15 critical state concern located in certain counties; 16 providing for certain municipalities to use the 17 proceeds of the surcharge for land acquisition or 18 beach renourishment or restoration; providing 19 limitations for purposes of determining state matching 20 funds; providing an effective date. 21 22 Be It Enacted by the Legislature of the State of Florida: 23 24 Section 1. Subsection (3) of section 258.0145, Florida 25 Statutes, is amended, and subsection (4) is added to that 26 section, to read: 27 258.0145 Military state park fee discounts.—The Division of 28 Recreation and Parks shall provide the following discounts on 29 park fees to persons who present written documentation 30 satisfactory to the division which evidences their eligibility 31 for the discounts: 32 (3) Surviving spouses and parents of deceased members of 33 the United States Armed Forces, National Guard, or reserve 34 components thereof who have fallen in combat shall receive 35 lifetime family annual entrance passes at no charge. 36 (4) The surviving spouse and parents of a law enforcement 37 officer, as defined in s. 943.10(1), or a firefighter, as 38 defined in s. 633.30(1), who has died in the line of duty shall 39 receive lifetime family annual entrance passes at no charge. 40 Section 2. Jack Mashburn Marina designated; Department of 41 Environmental Protection to erect suitable markers.— 42 (1) The marina commonly referred to as the “boat basin” on 43 Grand Lagoon at St. Andrews State Park in Bay County is 44 designated as “Jack Mashburn Marina.” 45 (2) The Department of Environmental Protection is directed 46 to erect suitable markers designating Jack Mashburn Marina as 47 described in subsection (1). 48 Section 3. Any property within the state park system which 49 has free-roaming animal populations is exempt from the 50 provisions of s. 588.15, Florida Statutes. 51 Section 4. Section 380.0685, Florida Statutes, is amended 52 to read: 53 380.0685 State park in area of critical state concern in 54 county which creates land authority; surcharge on admission and 55 overnight occupancy.—The Department of Environmental Protection 56 shall impose and collect a surcharge of 50 cents per person per 57 day, or $5 per annual family auto entrance permit, on admission 58 to all state parks in areas of critical state concern located in 59 a county which creates a land authority pursuant to s. 60 380.0663(1), and a surcharge of $2.50 per night per campsite, 61 cabin, or other overnight recreational occupancy unit in state 62 parks in areas of critical state concern located in a county 63 which creates a land authority pursuant to s. 380.0663(1); 64 however, no surcharge shall be imposed or collected under this 65 section for overnight use by nonprofit groups of organized group 66 camps, primitive camping areas, or other facilities intended 67 primarily for organized group use. Such surcharges shall be 68 imposed within 90 days after any county creating a land 69 authority notifies the Department of Environmental Protection 70 that the land authority has been created. The proceeds from such 71 surcharges, less a collection fee that shall be kept by the 72 Department of Environmental Protection for the actual cost of 73 collection, not to exceed 2 percent, shall be transmitted to the 74 land authority of the county from which the revenue was 75 generated. Such funds shall be used to purchase property in the 76 area or areas of critical state concern in the county from which 77 the revenue was generated. An amount not to exceed 10 percent 78 may be used for administration and other costs incident to such 79 purchases. However, the proceeds of the surcharges imposed and 80 collected pursuant to this section in a state park or parks 81 located wholly within a municipality, less the costs of 82 collection as provided herein, shall be transmitted to that 83 municipality for use by the municipality for land acquisition or 84 for beach renourishment or restoration, including, but not 85 limited to, costs associated with any design, permitting, 86 monitoring, and mitigation of such work, as well as the work 87 itself. However, these funds may not be included in any 88 calculation used for providing state matching funds for local 89 contributions for beach renourishment or restoration. The 90 surcharges levied under this section shall remain imposed as 91 long as the land authority is in existence. 92 Section 5. This act shall take effect July 1, 2011.
