Florida Senate - 2017 SB 432 By Senator Baxley 12-00562-17 2017432__ 1 A bill to be entitled 2 An act relating to vulnerable road users; creating s. 3 316.0265, F.S.; providing criminal penalties for a 4 person who commits a moving violation that causes 5 serious bodily injury to, or causes the death of, a 6 vulnerable road user; requiring such person to pay a 7 fine, serve a minimum period of house arrest, and 8 attend a driver improvement course; requiring the 9 court to revoke such person’s driver license for a 10 minimum specified period; providing construction; 11 providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 316.0265, Florida Statutes, is created 16 to read: 17 316.0265 Enhanced penalties for moving violations that 18 cause injury or death to vulnerable road users.— 19 (1) A person who commits a moving violation that causes 20 serious bodily injury, as defined in s. 316.027, to a vulnerable 21 road user, as defined in s. 316.027, commits a misdemeanor of 22 the second degree, punishable as provided in s. 775.082 or s. 23 775.083, and, upon conviction, shall pay a fine of not less than 24 $1,500, serve a minimum of 30 days of house arrest, and attend a 25 driver improvement course. The court shall also revoke the 26 person’s driver license for at least 30 days. 27 (2) A person who commits a moving violation that causes the 28 death of a vulnerable road user, as defined in s. 316.027, 29 commits a misdemeanor of the first degree, punishable as 30 provided in s. 775.082 or s. 775.083, and, upon conviction, 31 shall pay a fine of not less than $5,000, serve a minimum of 180 32 days of house arrest, and attend an advanced driver improvement 33 course in lieu of a department-approved driver improvement 34 course required under s. 322.0261. The court shall also revoke 35 the person’s driver license for at least 1 year. 36 (3) This section does not prohibit a person from being 37 charged with, convicted of, or punished for any other violation 38 of law. 39 Section 2. This act shall take effect October 1, 2017.
