Florida Senate - 2020 SB 532 By Senator Cruz 18-00570A-20 2020532__ 1 A bill to be entitled 2 An act relating to developmental disabilities; 3 providing a short title; amending s. 393.063, F.S.; 4 revising the definition of the term “developmental 5 disability”; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. This act may be cited as “Lincoln’s Law.” 10 Section 2. Subsection (12) of section 393.063, Florida 11 Statutes, is amended to read: 12 393.063 Definitions.—For the purposes of this chapter, the 13 term: 14 (12) “Developmental disability” means a severe, chronic 15 disability of an individual which: 16 (a) Is attributable to a mental or physical impairment or 17 combination of mental and physical impairments. 18 (b) Is manifested before the individual attains 22 years of 19 age. 20 (c) Is likely to continue indefinitely. 21 (d) Results in substantial functional limitations in three 22 or more of the following areas of major life activity: 23 1. Self-care. 24 2. Receptive and expressive language. 25 3. Learning. 26 4. Mobility. 27 5. Self-direction. 28 6. Capacity for independent living. 29 7. Economic self-sufficiency. 30 (e) Reflects the individual’s need for a combination and 31 sequence of special, interdisciplinary, or generic services, 32 individualized supports, or other forms of assistance which are 33 of lifelong or extended duration and are individually planned 34 and coordinated. 35 36 An individual from birth to 9 years of age who has a substantial 37 developmental delay or specific congenital or acquired condition 38 may be considered to have a developmental disability without 39 meeting three or more of the criteria described in paragraphs 40 (a)-(e) if the individual, without services and supports, has a 41 high probability of meeting such criteria later in lifedisorder42or syndrome that is attributable to intellectual disability,43cerebral palsy, autism, spina bifida, Down syndrome, Phelan44McDermid syndrome, or Prader-Willi syndrome; that manifests45before the age of 18; and that constitutes a substantial46handicap that can reasonably be expected to continue47indefinitely. 48 Section 3. This act shall take effect July 1, 2020.
