    1                        A bill to be entitled                      
    2         An act relating to in-store servicing of alcoholic
    3         beverages; amending s. 561.424, F.S.; conforming
    4         provisions to changes made by the act; creating s.
    5         561.425, F.S.; authorizing the in-store servicing of
    6         distilled spirits sold by a distributor to a vendor;
    7         defining the term “in-store servicing”; providing an
    8         effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Subsection (2) of section 561.424, Florida
   13  Statutes, is amended, and subsection (3) is added to that
   14  section, to read:
   15         561.424 Vinous beverages; in-store servicing authorized.—
   16         (2) Nothing in s. 561.42 or any other provision of the
   17  alcoholic beverage law prohibits shall prohibit a distributor of
   18  wine from providing in-store servicing of wine sold by the such
   19  distributor to a vendor.
   20         (3)As used in this section, the term “in-store servicing”
   21  as used herein means:
   22         (a) Placing the wine on the vendor’s shelves and
   23  maintaining the appearance and display of the said wine on the
   24  vendor’s shelves in the vendor’s licensed premises.;
   25         (b) Placing the wine that is not so shelved or displayed in
   26  a storage area designated by the vendor, which is located in the
   27  vendor’s licensed premises.;
   28         (c)Rotating rotation of vinous beverages.; and
   29         (d) Price stamping of vinous beverages in the vendor’s
   30  licensed premises. This section shall not apply to distilled
   31  spirits.
   32         Section 2. Section 561.425, Florida Statutes, is created to
   33  read:
   34         561.425Distilled spirits; in-store servicing authorized.—
   35         (1)Nothing in s. 561.42 or any other provision of the
   36  alcoholic beverage law prohibits a distributor of distilled
   37  spirits from providing in-store servicing of distilled spirits
   38  sold by the distributor to a vendor.
   39         (2)As used in this section, the term “in-store servicing”
   40  means:
   41         (a)Placing distilled spirits, including distilled spirits
   42  located in a storage area designated by the vendor, on the
   43  vendor’s shelves and maintaining the appearance and display of
   44  the distilled spirits on the vendor’s shelves in the vendor’s
   45  licensed premises.
   46         (b)Placing the distilled spirits in displays.
   47         (c)Placing the distilled spirits that are not shelved or
   48  displayed in a storage area designated by the vendor, which is
   49  located in the vendor’s licensed premises.
   50         (d)Rotating distilled spirits.
   51         (e)Price stamping distilled spirits in the vendor’s
   52  licensed premises.
   53         Section 3. This act shall take effect July 1, 2024.
