    1                        A bill to be entitled                      
    2         An act relating to concealed weapons and firearms;
    3         amending s. 790.06, F.S.; prohibiting a person from
    4         openly carrying a handgun or carrying a concealed
    5         weapon or firearm into a hospital, mental health
    6         facility, or nursing home unless such person is a
    7         security guard employed by the hospital, mental health
    8         facility, or hospital or a law enforcement officer;
    9         providing a criminal penalty; providing an effective
   10         date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (12) of section 790.06, Florida
   15  Statutes, is amended to read:
   16         790.06 License to carry concealed weapon or firearm.—
   17         (12)(a) A license issued under this section does not
   18  authorize a any person to openly carry a handgun or carry a
   19  concealed weapon or firearm into:
   20         1. A Any place of nuisance as defined in s. 823.05;
   21         2. A Any police, sheriff, or highway patrol station;
   22         3. A Any detention facility, prison, or jail;
   23         4. A Any courthouse;
   24         5. A Any courtroom, except that nothing in this section
   25  would preclude a judge may carry from carrying a concealed
   26  weapon or determine determining who may will carry a concealed
   27  weapon in his or her courtroom;
   28         6. A Any polling place;
   29         7. A Any meeting of the governing body of a county, public
   30  school district, municipality, or special district;
   31         8. A Any meeting of the Legislature or a legislative
   32  committee thereof;
   33         9. A Any school, college, or professional athletic event
   34  not related to firearms;
   35         10. An Any elementary or secondary school facility or
   36  administration building;
   37         11. A Any career center;
   38         12. A Any portion of an establishment licensed to dispense
   39  alcoholic beverages for consumption on the premises, which
   40  portion of the establishment is primarily devoted to that such
   41  purpose;
   42         13. A Any college or university facility unless the
   43  licensee is a registered student, employee, or faculty member of
   44  such college or university and the weapon is a stun gun or
   45  nonlethal electric weapon or device designed solely for
   46  defensive purposes and the weapon does not fire a dart or
   47  projectile;
   48         14. The inside of the passenger terminal and sterile area
   49  of an any airport; however, a provided that no person may not
   50  shall be prohibited from carrying a any legal firearm into the
   51  terminal if the, which firearm is encased for shipment for
   52  purposes of checking such firearm as baggage to be lawfully
   53  transported on an any aircraft; or
   54         15. A hospital, mental health facility, or nursing home
   55  unless the person is a security guard employed by the hospital,
   56  mental health facility, or nursing home or a law enforcement
   57  officer; or
   58         16.15. Any place where the carrying of firearms is
   59  prohibited by federal law.
   60         (b) A person licensed under this section may shall not be
   61  prohibited from carrying or storing a firearm in a vehicle for
   62  lawful purposes.
   63         (c) This section does not modify the terms or conditions of
   64  s. 790.251(7).
   65         (d) A Any person who knowingly and willfully violates any
   66  provision of this subsection commits a misdemeanor of the second
   67  degree, punishable as provided in s. 775.082 or s. 775.083.
   68         Section 2. This act shall take effect July 1, 2014.
