Florida Senate - 2021 SB 608 By Senator Bean 4-00967-21 2021608__ 1 A bill to be entitled 2 An act relating to fees; amending s. 741.327, F.S., as 3 revived, reenacted, and amended by SB ___; requiring 4 the Department of Children and Families to assess and 5 collect an annual certification fee from batterers’ 6 intervention programs and certain persons attending 7 certified batterers’ intervention programs; requiring 8 certification and user fees to be deposited in the 9 Domestic Violence Trust Fund for a specified purpose; 10 providing a contingent effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 741.327, Florida Statutes, as revived, 15 reenacted, and amended by SB ___, is amended, to read: 16 741.327 Certification and monitoring of batterers’ 17 intervention programs; rules; fees.— 18 (1) Pursuant to s. 741.32, the Department of Children and 19 Families shall certify and monitor batterers’ intervention 20 programs and assess and collect certification and user fees. 21 (2) The department shall adopt by rule procedures to 22 administer this section, including, but not limited to, 23 procedures related to all of the following: 24 (a) The development of criteria for the approval, 25 suspension, or rejection of certification of batterers’ 26 intervention programs. 27 (b) The assessment and collection of annual fees for the 28 certification and monitoring of batterers’ intervention 29 programs. 30 (c) The assessment and collection of fees for individuals 31 who are ordered by the court to complete, or who voluntarily 32 enroll in, a certified batterers’ intervention program. 33 (3) The fees assessed and collected under this section 34 shall be deposited in the Executive Office of the Governor’s 35 Domestic Violence Trust Fund established in s. 741.01 and shall 36 be directed to the Department of Children and Families to fund 37 the cost of certifying and monitoring batterers’ intervention 38 programs. 39 Section 2. This act shall take effect on the same date that 40 SB ___ or similar legislation takes effect, if such legislation 41 is adopted in the same legislative session or an extension 42 thereof and becomes a law.
