Florida Senate - 2021 SB 612 By Senator Stewart 13-00668-21 2021612__ 1 A bill to be entitled 2 An act relating to specialty license plates; amending 3 s. 320.08058, F.S.; directing the Department of 4 Highway Safety and Motor Vehicles to develop certain 5 license plates; providing for the distribution and use 6 of fees collected from the sale of such plates; 7 providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsections (112), (113), and (114) are added to 12 section 320.08058, Florida Statutes, to read: 13 320.08058 Specialty license plates.— 14 (112) TOASTMASTERS LICENSE PLATES.— 15 (a) The department shall develop a Toastmasters license 16 plate as provided in this section and s. 320.08053. The plate 17 must bear the colors and design approved by the department. The 18 word “Florida” must appear at the top of the plate, and the 19 words “www.Toastmasters.org” must appear at the bottom of the 20 plate. 21 (b) The annual use fees from the sale of the plate shall be 22 distributed to the Ralph C. Smedley Memorial Fund of 23 Toastmasters International, a s. 501(c)(3) nonprofit 24 organization, of which: 25 1. Twenty-five percent shall be used to develop charitable 26 and educational programs for the indigent, homeless, visually 27 and hearing disabled, incarcerated, and youth populations that 28 are unable to afford or to participate in established 29 Toastmasters programs. Up to 5 percent of this distribution may 30 be used for administrative expenses. 31 2. Seventy-five percent shall be proportionally 32 redistributed to the divisions of Districts 47, 48, 77, and 84 33 of Toastmasters International which reside in this state. Up to 34 5 percent of this distribution may be used for marketing of the 35 plate, and the remainder shall be used for educators, 36 nonprofits, governmental organizations, scholarships, materials, 37 and computers and other equipment for the purpose of 38 implementing the charitable and educational programs for the 39 indigent, homeless, visually and hearing disabled, incarcerated, 40 and youth populations that are unable to afford or to 41 participate in the established Toastmasters programs. 42 (113) GOPHER TORTOISE LICENSE PLATES.— 43 (a) The department shall develop a Gopher Tortoise license 44 plate as provided in this section and s. 320.08053. The plate 45 must bear the colors and design approved by the department. The 46 word “Florida” must appear at the top of the plate, and the 47 words “Protect the Gopher Tortoise” must appear at the bottom of 48 the plate. 49 (b) The annual use fees from the sale of the plate shall be 50 distributed to Wildlands Conservation, Inc., a nonprofit 51 corporation under s. 501(c)(3) of the Internal Revenue Code, to 52 fund gopher tortoise and commensal species research, education, 53 and conservation, as well as upland habitat protection, 54 restoration, and management in this state. Up to 15 percent of 55 the funds received by Wildlands Conservation, Inc., may be used 56 for marketing of the plate and costs directly associated with 57 the administration of the gopher tortoise protection program. 58 Wildlands Conservation, Inc., shall use and distribute the funds 59 to eligible Florida-based scientific, conservation, and 60 educational organizations for gopher tortoise and upland habitat 61 research, conservation, and management. 62 (114) ORLANDO UNITED LICENSE PLATES.— 63 (a) The department shall develop an Orlando United license 64 plate as provided in this section and s. 320.08053. The plate 65 must bear the colors and design approved by the department. The 66 word “Florida” must appear at the top of the plate, and the 67 words “Orlando United” must appear at the bottom of the plate. 68 (b) The annual use fees from the sale of the plate shall be 69 distributed as follows: 70 1. Five percent shall be distributed to the Mental Health 71 Association of Central Florida, Inc., to be used for marketing 72 of the license plate. 73 2. Thirty-one percent shall be distributed to the Mental 74 Health Association of Central Florida, Inc. Of this amount, up 75 to 5 percent may be used for administrative expenses, and the 76 remainder shall be used to offer free personalized counseling to 77 any person affected by the shooting at the Pulse nightclub in 78 Orlando on June 12, 2016. 79 3. Two percent shall be distributed to onePULSE Foundation, 80 Inc., a charitable, nonprofit organization under s. 501(c)(3) of 81 the Internal Revenue Code, to be used for marketing of the 82 license plate. 83 4. Thirty-one percent shall be distributed to onePULSE 84 Foundation, Inc. Of this amount, up to 5 percent may be used for 85 administrative expenses, and the remainder shall be used to 86 support the construction and maintenance of the onePULSE 87 Foundation Memorial. 88 5. Thirty-one percent shall be distributed to Two Spirit 89 Health Services, Inc. Of this amount, up to 5 percent may be 90 used for administrative expenses, and the remainder shall be 91 used to offer free personalized counseling to any person 92 affected by the shooting at the Pulse nightclub in Orlando on 93 June 12, 2016. 94 Section 2. This act shall take effect July 1, 2021.
