Florida Senate - 2022 SB 612 By Senator Hutson 7-00616-22 2022612__ 1 A bill to be entitled 2 An act relating to apprenticeship contracts; creating 3 s. 446.093, F.S.; defining terms; authorizing an 4 apprentice to enter into a contract with a business 5 organization for a specified duration; requiring such 6 contracts to be signed by specified individuals; 7 providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 446.093, Florida Statutes, is created to 12 read: 13 446.093 Apprenticeship contracts.— 14 (1) As used in this section, the term: 15 (a) “Apprentice” means a person who is engaged in learning 16 or gaining experience in a recognized skilled trade through 17 actual work experience for a fixed period of time. 18 (b) “Business organization” means a corporation; a general 19 partnership, including a limited liability partnership; a 20 limited partnership, including a limited liability limited 21 partnership; a limited liability company; common law or business 22 trust or association; a nonprofit organization as defined in s. 23 768.1355(1)(b)1.; or any other person or entity organized under 24 a governing statute or other applicable law. The term includes 25 domestic and foreign organizations. 26 (c) “Contract” means an agreement between a business 27 organization and an apprentice which defines the terms of the 28 apprenticeship and includes minimum requirements for learning 29 outcomes, compensation, expectations, and duration of the 30 apprenticeship. 31 (d) “Head of the business organization” means the executive 32 director, director, general partner, manager, or any other 33 person under whose authority the powers of the business 34 organization are exercised and under whose direction the 35 activities and affairs of the business organization are managed. 36 (2) Notwithstanding any other law, an apprentice may enter 37 into a contract with a business organization for up to 3 years. 38 The contract must be signed by the head of the business 39 organization and the apprentice. If the apprentice is younger 40 than 18 years of age, the parent or legal guardian of the 41 apprentice must also sign the contract. 42 Section 2. This act shall take effect July 1, 2022.
