Florida Senate - 2021 CS for CS for SB 626 By the Committees on Criminal Justice; and Children, Families, and Elder Affairs; and Senators Bracy and Torres 591-02928-21 2021626c2 1 A bill to be entitled 2 An act relating to juvenile justice; creating s. 3 985.031, F.S.; providing a short title; prohibiting a 4 child younger than a certain age from being taken into 5 custody, arrested, charged, or adjudicated delinquent 6 for a delinquent act or violation of law; providing an 7 exception; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 985.031, Florida Statutes, is created to 12 read: 13 985.031 Age limitation; exception.— 14 (1) This section may be cited as the “Kaia Rolle Act.” 15 (2) A child younger than 7 years of age may not be taken 16 into custody, arrested, charged, or adjudicated delinquent for a 17 delinquent act or violation of law based on an act occurring 18 before he or she reaches 7 years of age, unless the violation of 19 law is a forcible felony as defined in s. 776.08. 20 Section 2. This act shall take effect July 1, 2021.
