Florida Senate - 2013 CS for CS for SB 650 By the Committees on Criminal Justice; and Agriculture; and Senator Sachs 591-03857-13 2013650c2 1 A bill to be entitled 2 An act relating to the artificial coloring and sale of 3 certain animals and fowl; creating s. 828.1615, F.S.; 4 providing that it is unlawful to sell, barter, or give 5 away animals or fowl that have been dyed or colored; 6 providing that it is unlawful to sell, offer to sell, 7 or give away certain animals of a certain age to be 8 used as pets, toys, or retail premiums; providing 9 exceptions; providing criminal penalties; providing an 10 effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 828.1615, Florida Statutes, is created 15 to read: 16 828.1615 Prohibiting artificial coloring and sale of 17 certain animals and fowl; construction.— 18 (1) It is unlawful for a person, firm, or corporation, to 19 sell, barter, or give away any animal or fowl that has been dyed 20 or artificially colored, including, but not limited to, rabbits, 21 baby chickens, and ducklings. 22 (2) It is unlawful for a person to sell, offer for sale, or 23 give away as merchandising premiums, baby chickens, ducklings, 24 or other fowl under 4 weeks of age or rabbits under 2 months of 25 age to be used as pets, toys, or retail premiums. 26 (3) This section does not apply to any animal or fowl, 27 including, but not limited to, rabbits, baby chickens, and 28 ducklings, to be used or raised for agricultural purposes by 29 persons with proper facilities to care for them, by agricultural 30 entities for protective health purposes, or for poultry or 31 livestock exhibitions. 32 (4) A person violating this section commits a misdemeanor 33 of the second degree, punishable as provided in s. 775.082 or s. 34 775.083. 35 Section 2. This act shall take effect July 1, 2013.
