    1                        A bill to be entitled                      
    2         An act relating to postsecondary educational
    3         institution fee waivers; amending s. 1009.26, F.S.;
    4         requiring a state university, a Florida College System
    5         institution, a career center operated by a school
    6         district, or a charter technical career center to
    7         waive out-of-state fees for students who have a
    8         current temporary protected status; requiring such
    9         institutions to require the student to provide
   10         supporting documentation for the status; providing an
   11         effective date.

   13  Be It Enacted by the Legislature of the State of Florida:
   14  
   15         Section 1. Subsection (12) of section 1009.26, Florida
   16  Statutes, is amended to read:
   17         1009.26 Fee waivers.—
   18         (12)(a) A state university, a Florida College System
   19  institution, a career center operated by a school district under
   20  s. 1001.44, or a charter technical career center shall waive
   21  out-of-state fees for students, including, but not limited to,
   22  students who are undocumented for federal immigration purposes
   23  or who have a current temporary protected status, as designated
   24  by the Department of Homeland Security, who meet the following
   25  conditions:
   26         1. Attended a secondary school in this state for 3
   27  consecutive years immediately before graduating from a high
   28  school in this state;
   29         2. Apply for enrollment in an institution of higher
   30  education within 24 months after high school graduation; and
   31         3. Submit an official Florida high school transcript as
   32  evidence of attendance and graduation.
   33         (b) Tuition and fees charged to a student who qualifies for
   34  the out-of-state fee waiver under this subsection may not exceed
   35  the tuition and fees charged to a resident student. The waiver
   36  is applicable for 110 percent of the required credit hours of
   37  the degree or certificate program for which the student is
   38  enrolled. Each state university, Florida College System
   39  institution, career center operated by a school district under
   40  s. 1001.44, and charter technical career center shall report to
   41  the Board of Governors and the State Board of Education,
   42  respectively, the number and value of all fee waivers granted
   43  annually under this subsection. By October 1 of each year, the
   44  Board of Governors for the state universities and the State
   45  Board of Education for Florida College System institutions,
   46  career centers operated by a school district under s. 1001.44,
   47  and charter technical career centers shall annually report for
   48  the previous academic year the percentage of resident and
   49  nonresident students enrolled systemwide.
   50         (c) A state university student granted an out-of-state fee
   51  waiver under this subsection must be considered a nonresident
   52  student for purposes of calculating the systemwide total
   53  enrollment of nonresident students as limited by regulation of
   54  the Board of Governors. In addition, a student who is granted an
   55  out-of-state fee waiver under this subsection is not eligible
   56  for state financial aid under part III of this chapter and must
   57  not be reported as a resident for tuition purposes.
   58         (d) A state university, a Florida College System
   59  institution, a career center operated by a school district under
   60  s. 1001.44, or a charter technical career center shall, within
   61  the nonresident student enrollment systemwide, prioritize the
   62  enrollment of a veteran who is granted an out-of-state fee
   63  waiver pursuant to the Congressman C.W. “Bill” Young Tuition
   64  Waiver Act over a student who is granted an out-of-state fee
   65  waiver under this subsection.
   66         (e) A state university, a Florida College System
   67  institution, a career center operated by a school district under
   68  s. 1001.44, or a charter technical career center shall require a
   69  student to provide documentation supporting their temporary
   70  protected status.
   71         Section 2. This act shall take effect July 1, 2017.
