Florida Senate - 2023 SB 806 By Senator Harrell 31-01526A-23 2023806__ 1 A bill to be entitled 2 An act relating to organ transplants; amending s. 3 395.1055, F.S.; requiring the Agency for Health Care 4 Administration to adopt by rule specified minimum 5 standards for certain organ transplants; providing 6 that hospitals that do not meet these standards by, or 7 begin organ transplant programs after, a specified 8 date have 3 years to meet such standards and must 9 maintain them thereafter; providing construction; 10 providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Paragraphs (i) and (j) are added to subsection 15 (1) of section 395.1055, Florida Statutes, to read: 16 395.1055 Rules and enforcement.— 17 (1) The agency shall adopt rules pursuant to ss. 120.536(1) 18 and 120.54 to implement the provisions of this part, which shall 19 include reasonable and fair minimum standards for ensuring that: 20 (i) Hospitals providing adult organ transplants which meet 21 the following annual minimum volume of transplants by organ type 22 as of July 1, 2023, maintain these volumes, based on a rolling 23 3-year average: 24 1. For heart transplants, performance of at least 12 25 transplants per year. 26 2. For liver transplants, performance of at least 5 27 transplants per year. 28 3. For kidney transplants, performance of at least 15 29 transplants per year. 30 4. For lung transplants, performance of at least 10 31 transplants per year. 32 5. For allogenic and autologous bone marrow transplants, 33 performance of at least 10 transplants per year of each such 34 transplant a hospital offers. 35 36 Hospitals that do not meet these annual minimum volumes by, or 37 that begin adult organ transplant programs after, July 1, 2023, 38 have 3 years to achieve the minimum volumes required by this 39 paragraph and must thereafter maintain such volumes based on a 40 rolling 3-year average. 41 (j) Hospitals providing pediatric organ transplants which 42 meet the following minimum volume of transplants by organ type 43 as of July 1, 2023, maintain these volumes, based on a rolling 44 3-year average: 45 1. For kidney transplants, performance of at least 5 46 transplants on average per biennium. 47 2. For allogenic and autologous bone marrow transplants, 48 performance of at least 10 transplants per year of each such 49 transplant a hospital offers. 50 51 Hospitals that do not meet these minimum volumes by, or that 52 begin pediatric organ transplant programs after, July 1, 2023, 53 have 3 years to achieve the minimum volumes required by this 54 paragraph and must thereafter maintain such volumes based on a 55 rolling 3-year average. For purposes of this paragraph, a 56 pediatric patient includes patients younger than 21 years of 57 age. 58 Section 2. This act shall take effect July 1, 2023.
