Florida Senate - 2016 SB 810 By Senator Thompson 12-00941-16 2016810__ 1 A bill to be entitled 2 An act relating to investigation of lethal force by 3 law enforcement officers; creating s. 943.69, F.S.; 4 defining the term “law enforcement agency”; requiring 5 the head of a law enforcement agency to report to the 6 Department of Law Enforcement within a specified time 7 if the use of force by a law enforcement officer 8 results in the death of another person; requiring the 9 head of a law enforcement agency to provide the 10 department within a specified time the results of the 11 agency’s investigation; requiring the department to 12 conduct an independent investigation into such use of 13 force; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. Section 943.69, Florida Statutes, is created to 18 read: 19 943.69 Investigation of lethal force by officers.— 20 (1) As used in this section, the term “law enforcement 21 agency” means an agency or a unit of government that has 22 authority to employ or appoint a law enforcement officer as 23 defined in s. 943.10. 24 (2) The head of a law enforcement agency must report to the 25 department within 24 hours if a law enforcement officer uses 26 force that results in the death of another person. If the law 27 enforcement agency conducts an investigation into the use of 28 force by the officer, the head of the law enforcement agency 29 must provide the results of the investigation to the department 30 within 7 days after completion of the investigation. 31 (3) The department shall conduct an independent 32 investigation into the use of force by a law enforcement officer 33 which results in the death of another person. 34 Section 2. This act shall take effect July 1, 2016.
