    1                        A bill to be entitled                      
    2         An act relating to first aid for severe bleeding;
    3         amending s. 768.1326, F.S.; requiring the State
    4         Surgeon General to adopt rules to establish guidelines
    5         for the placement of bleeding control kits in state
    6         buildings by a specified date; providing requirements
    7         for such guidelines and the placement of such kits in
    8         state buildings; amending s. 1001.42, F.S.; requiring
    9         district school boards to provide a bleeding control
   10         kit in every school within the school district;
   11         providing requirements for such kits; creating s.
   12         1003.457, F.S.; requiring school districts to provide
   13         instruction for all students in first aid for severe
   14         bleeding; requiring students to study and practice
   15         skills associated with first aid for severe bleeding
   16         at least once before graduating from high school;
   17         requiring that the instruction be a part of a required
   18         curriculum and be based on certain programs; providing
   19         an exemption; creating s. 1012.5841, F.S.; requiring
   20         the Department of Education to develop a list of
   21         approved first aid for severe bleeding instructional
   22         programs for certain instructional personnel by a
   23         specified date; providing requirements for such list;
   24         requiring the department to incorporate such training
   25         programs into existing requirements for continuing
   26         education or inservice training for such personnel by
   27         a specified school year; prohibiting such requirements
   28         from adding to the total hours required for such
   29         education and training; authorizing the State Board of
   30         Education to adopt rules; providing an effective date.
   31          
   32  Be It Enacted by the Legislature of the State of Florida:
   33  
   34         Section 1. Section 768.1326, Florida Statutes, is amended
   35  to read:
   36         768.1326 Placement of automated external defibrillator
   37  devices and bleeding control kits defibrillators in state
   38  buildings; rulemaking authority.—No later than January 1, 2021
   39  2003, the State Surgeon General shall adopt rules to establish
   40  guidelines on the appropriate placement of automated external
   41  defibrillator devices and bleeding control kits in buildings or
   42  portions of buildings owned or leased by the state, and shall
   43  establish, by rule, recommendations on procedures for the
   44  deployment of automated external defibrillator devices and
   45  bleeding control kits in such buildings in accordance with the
   46  guidelines. The Secretary of Management Services shall assist
   47  the State Surgeon General in the development of the guidelines.
   48  The guidelines for the placement of the automated external
   49  defibrillator devices and bleeding control kits defibrillators
   50  shall take into account the typical number of employees and
   51  visitors in the buildings, the extent of the need for security
   52  measures regarding the buildings, special circumstances in
   53  buildings or portions of buildings such as high electrical
   54  voltages or extreme heat or cold, and such other factors as the
   55  State Surgeon General and Secretary of Management Services
   56  determine to be appropriate. The State Surgeon General’s
   57  recommendations for deployment of automated external
   58  defibrillator devices and bleeding control kits defibrillators
   59  in buildings or portions of buildings owned or leased by the
   60  state shall include:
   61         (1) A reference list of appropriate training courses in the
   62  use of such devices and kits, including the role of
   63  cardiopulmonary resuscitation;
   64         (2) The extent to which such devices and kits may be used
   65  by laypersons;
   66         (3) Manufacturer recommended maintenance and testing of the
   67  devices and, if appropriate, kits; and
   68         (4) Coordination with local emergency medical services
   69  systems regarding the incidents of use of the devices and kits.
   70  
   71  In formulating these guidelines and recommendations, the State
   72  Surgeon General may consult with all appropriate public and
   73  private entities, including national and local public health
   74  organizations that seek to improve the survival rates of
   75  individuals who experience cardiac arrest or injuries that would
   76  require a bleeding control kit.
   77         Section 2. Subsection (28) of section 1001.42, Florida
   78  Statutes, is redesignated as subsection (29), and a new
   79  subsection (28) is added to that section, to read:
   80         1001.42 Powers and duties of district school board.—The
   81  district school board, acting as a board, shall exercise all
   82  powers and perform all duties listed below:
   83         (28)BLEEDING CONTROL KITS.—Provide at least one bleeding
   84  control kit in every school within the school district. The
   85  bleeding control kit must include, at a minimum, a tourniquet,
   86  trauma dressings, gauze, two pairs of nitrile gloves, trauma
   87  shears, and instructions.
   88         Section 3. Section 1003.457, Florida Statutes, is created
   89  to read:
   90         1003.457Instruction in first aid for severe bleeding.—
   91         (1)Each school district shall provide instruction for all
   92  students in first aid for severe bleeding. The students shall
   93  study and practice the skills associated with first aid for
   94  severe bleeding at least once before graduating from high
   95  school. The instruction must be a part of the physical education
   96  curriculum or another required curriculum selected by the school
   97  district.
   98         (2)The required instruction must be based on an
   99  instructional program established by the American College of
  100  Surgeons or another nationally recognized program that uses the
  101  most current evidence-based emergency care guidelines.
  102         (3)A student with a disability, as defined in s. 1007.02,
  103  is exempt from the requirements of this section.
  104         Section 4. Section 1012.5841, Florida Statutes, is created
  105  to read:
  106         1012.5841Continuing education and inservice training for
  107  first aid for severe bleeding.—
  108         (1)By July 1, 2021, the Department of Education shall
  109  develop a list of approved first aid for severe bleeding
  110  instructional programs for instructional personnel in elementary
  111  school, middle school, and high school. The approved list must
  112  include instructional programs established by the American
  113  College of Surgeons or another nationally recognized program
  114  that uses the most current evidence-based emergency care
  115  guidelines.
  116         (2)Beginning with the 2021-2022 school year, the
  117  Department of Education shall incorporate the first aid for
  118  severe bleeding instructional programs into existing
  119  requirements for the continuing education or inservice training
  120  of instructional personnel. The requirements of this section may
  121  not add to the total hours required for continuing education or
  122  inservice training as currently established by the department.
  123         (3)The State Board of Education may adopt rules to
  124  implement this section.
  125         Section 5. This act shall take effect July 1, 2020.
