Florida Senate - 2022 CS for CS for SB 954 By the Committees on Appropriations; and Governmental Oversight and Accountability; and Senators Brodeur, Brandes, and Pizzo 576-03371-22 2022954c2 1 A bill to be entitled 2 An act relating to energy; amending s. 286.29, F.S.; 3 revising the selection criteria for purchasing or 4 leasing vehicles for state agency, college, or 5 university or certain local government fleets; 6 removing a provision requiring the use and procurement 7 of ethanol and biodiesel fuels; requiring the 8 Department of Management Services, before a specified 9 date, to make recommendations to state agencies and 10 local governments relating to the procurement and 11 integration of electric and natural gas fuel vehicles; 12 amending s. 553.791, F.S.; revising the definition of 13 the term “single-trade inspection”; providing an 14 effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Subsections (4) and (5) of section 286.29, 19 Florida Statutes, are amended to read: 20 286.29 Climate-friendly public business.—The Legislature 21 recognizes the importance of leadership by state government in 22 the area of energy efficiency and in reducing the greenhouse gas 23 emissions of state government operations. The following shall 24 pertain to all state agencies when conducting public business: 25 (4) When procuring new vehicles, all state agencies, state 26 universities, community colleges, and local governments that 27 purchase vehicles under a state purchasing plan shall first 28 define the intended purpose for the vehicle and determine which 29 of the following use classes for which the vehicle is being 30 procured: 31 (a) State business travel, designated operator; 32 (b) State business travel, pool operators; 33 (c) Construction, agricultural, or maintenance work; 34 (d) Conveyance of passengers; 35 (e) Conveyance of building or maintenance materials and 36 supplies; 37 (f) Off-road vehicle, motorcycle, or all-terrain vehicle; 38 (g) Emergency response; or 39 (h) Other. 40 41 Vehicles described in paragraphs (a) through (h), when being 42 processed for purchase or leasing agreements, must be selected 43 based on the lowest lifetime ownership costs, including costs 44 for fuel, operations, and maintenance,for the greatest fuel45efficiency availablefor a given use classwhen fuel economy46data are available. Exceptions may be made for individual 47 vehicles in paragraph (g) when accompanied, during the 48 procurement process, by documentation indicating that the 49 operator or operators will exclusively be emergency first 50 responders or have special documented need for exceptional 51 vehicle performance characteristics. Any request for an 52 exception must be approved by the purchasing agency head and any 53 exceptional performance characteristics denoted as a part of the 54 procurement process prior to purchase. 55(5) All state agencies shall use ethanol and biodiesel56blended fuels when available. State agencies administering57central fueling operations for state-owned vehicles shall58procure biofuels for fleet needs to the greatest extent59practicable.60 Section 2. Before July 1, 2023, the Department of 61 Management Services shall make recommendations to state 62 agencies, including state colleges and universities, and local 63 governments regarding the procurement of electric and natural 64 gas fuel vehicles and best practices for integrating such 65 vehicles into existing fleets. 66 Section 3. Paragraph (p) of subsection (1) of section 67 553.791, Florida Statutes, is amended to read: 68 553.791 Alternative plans review and inspection.— 69 (1) As used in this section, the term: 70 (p) “Single-trade inspection” means any inspection focused 71 on a single construction trade, such as plumbing, mechanical, or 72 electrical. The term includes, but is not limited to, 73 inspections of door or window replacements; fences and block 74 walls more than 6 feet high from the top of the wall to the 75 bottom of the footing; stucco or plastering; reroofing with no 76 structural alteration; HVAC replacements; installation of 77 electric vehicle charging stations; solar energy and energy 78 storage installations or alterations; ductwork or fan 79 replacements; alteration or installation of wiring, lighting, 80 and service panels; water heater changeouts; sink replacements; 81 and repiping. 82 Section 4. This act shall take effect July 1, 2022.
