ENROLLED 2011 Legislature CS for SB 960 2011960er 1 2 An act relating to liquefied petroleum gas; amending 3 s. 527.06, F.S.; prohibiting the Department of 4 Agriculture and Consumer Services and other state 5 agencies from requiring compliance with certain 6 national standards for liquefied petroleum gas tanks 7 unless the department or agencies require compliance 8 with a specified edition of the national standards; 9 providing for future expiration of such requirements; 10 amending s. 527.21, F.S.; revising the term “propane” 11 for purposes of the Florida Propane Gas Education, 12 Safety, and Research Act, to incorporate changes to 13 certain national standards in a reference thereto; 14 providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Subsection (3) of section 527.06, Florida 19 Statutes, is amended to read: 20 527.06 Rules.— 21 (3)(a) Rules in substantial conformity with the published 22 standards of the National Fire Protection Association (NFPA) are 23shall bedeemed to be in substantial conformity with the 24 generally accepted standards of safety concerning the same 25 subject matter. 26 (b) Notwithstanding any other law, the department or other 27 state agency may not require compliance with the minimum 28 separation distances of NFPA 58 for separation between a 29 liquefied petroleum gas tank and a building, adjoining property 30 line, other liquefied petroleum gas tank, or any source of 31 ignition, except in compliance with the minimum separation 32 distances of the 2011 edition of NFPA 58. This paragraph expires 33 upon the last effective date of rules adopted, directly or 34 incorporated by reference, by the department, the Florida 35 Building Commission as part of the Florida Building Code, and 36 the Office of State Fire Marshal as part of the Florida Fire 37 Prevention Code of these minimum separation distances contained 38 in the 2011 edition of NFPA 58, promulgated by the National Fire 39 Protection Association. 40 Section 2. Subsection (11) of section 527.21, Florida 41 Statutes, is amended to read: 42 527.21 Definitions relating to Florida Propane Gas 43 Education, Safety, and Research Act.—As used in ss. 527.20 44 527.23, the term: 45 (11) “Propane” includes propane, butane, mixtures, and 46 liquefied petroleum gas as defined bytheNational Fire 47 Protection Association (NFPA)Standard58,For The Storage and48Handling ofLiquefied Petroleum Gas CodeGases. 49 Section 3. This act shall take effect July 1, 2011.
