Florida Senate - 2011 SB 986 By Senator Bennett 21-01468-11 2011986__ 1 A bill to be entitled 2 An act relating to the Division of Alcoholic Beverages 3 and Tobacco of the Department of Business and 4 Professional Regulation; amending s. 561.422, F.S.; 5 revising provisions relating to issuance by the 6 division of temporary permits to nonprofit civic 7 organizations to sell alcoholic beverages; permitting 8 the issuance of permits to any nonprofit organization; 9 allowing the sale to include beverages for consumption 10 on or off the premises; providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 561.422, Florida Statutes, is amended to 15 read: 16 561.422 Nonprofitcivicorganizations; temporary permits. 17 Upon the filing of an application, presentation of a local 18 building and zoning permit, and payment of a fee of $25 per 19 permit, the director of the division may issue a permit 20 authorizing a bona fide nonprofitcivicorganization to sell 21 alcoholic beverages for consumption on or off the premisesonly, 22 for a period not to exceed 3 days, subject to any state law or 23 municipal or county ordinance regulating the time for selling 24 such beverages. All net profits from sales of alcoholic 25 beverages collected during the permit period must be retained by 26 the nonprofitcivicorganization. Any suchcivicorganization 27 may be issued only three such permits per calendar year. 28 Notwithstanding other provisions of the Beverage Law, anycivic29 organization licensed under this section may purchase alcoholic 30 beverages from a distributor or vendor licensed under the 31 Beverage Law. 32 Section 2. This act shall take effect July 1, 2011.
