Florida Senate - 2017 SB 1198 By Senator Bracy 11-00861-17 20171198__ 1 A bill to be entitled 2 An act relating to presentencing information; 3 requiring the Office of Program Policy Analysis and 4 Government Accountability (OPPAGA) to conduct a study 5 on the presentencing information provided to judges in 6 this state and the manner by which that information is 7 provided; requiring the office to examine alternative 8 means of providing such information; requiring the 9 Department of Corrections and the Office of the State 10 Courts Administrator, upon request, to assist OPPAGA 11 with the study; requiring OPPAGA, on or before a 12 certain date, to submit a report to the Governor and 13 the Legislature; providing an effective date. 14 15 Be It Enacted by the Legislature of the State of Florida: 16 17 Section 1. The Office of Program Policy Analysis and 18 Government Accountability (OPPAGA) shall conduct a study on the 19 presentencing information provided to judges in this state and 20 the manner in which that information is provided. The study must 21 also examine alternatives to the way Florida provides judges 22 with presentencing information, such as Missouri’s searchable 23 electronic database of sentencing information. The study must 24 include findings regarding the advantages, disadvantages, and 25 feasibility of the adoption in this state of features of other 26 states’ models for providing presentencing information. Upon 27 request, the Department of Corrections and the Office of State 28 Courts Administrator shall assist OPPAGA by providing 29 information that it determines is necessary to complete its 30 report. On or before October 1, 2017, OPPAGA shall provide its 31 report to the Governor, the President of the Senate, and the 32 Speaker of the House of Representatives. 33 Section 2. This act shall take effect upon becoming a law.
