Florida Senate - 2021 SB 1226 By Senator Jones 35-00716-21 20211226__ 1 A bill to be entitled 2 An act relating to state contracting; amending s. 3 287.057, F.S.; requiring an agency subject to ch. 287, 4 F.S., to require any vendor awarded a competitively 5 solicited contract for commodities or contractual 6 services to use certified minority, woman-owned, or 7 veteran-owned business enterprises as subcontractors 8 or subvendors for a specified portion of the contract 9 value; requiring a vendor to identify subcontractors 10 or subvendors when bidding for such a contract; 11 requiring the vendor to report certain information 12 regarding subcontractors or subvendors upon 13 performance or completion of the contract; providing 14 an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Subsection (8) of section 287.057, Florida 19 Statutes, is amended to read: 20 287.057 Procurement of commodities or contractual 21 services.— 22 (8) An agency shall require thatmay reserveany contract 23 for competitive solicitation may be awarded only toonly among24 vendors who agree to use certified minority business 25 enterprises, woman-owned business enterprises, or veteran-owned 26 business enterprises as subcontractors or subvendors for at 27 least 30 percent of the value of the contract. The percentage of 28 funds, in terms of gross contract amount and revenues, which 29 must be expended with suchthe certified minority business30enterprisesubcontractors and subvendors shall be determined by 31 the agency before the contract is made available for bidding 32such contracts may be reserved. In order to bid on a contractso33reserved, the vendor mustshallidentify those certified 34 minority business enterprises, woman-owned business enterprises, 35 or veteran-owned business enterprises thatwhichwill be used 36utilizedas subcontractors or subvendors by sworn statement. At 37 the time of performance or project completion, the contractor 38 shall report by sworn statement the payments and completion of 39 work for all certified minority business enterprises, woman 40 owned business enterprises, or veteran-owned business 41 enterprises used in the contract. 42 Section 2. This act shall take effect July 1, 2021.
