    1                        A bill to be entitled                       
    2         An act relating to the Department of Agriculture and 
    3         Consumer Services; requiring that the department and 
    4         representatives of the state pest control industry 
    5         prepare a report for the President of the Senate, the 
    6         Speaker of the House of Representatives, and the 
    7         chairpersons of specified legislative committees by a 
    8         certain date; requiring that the report include 
    9         recommendations for changes in the law to provide for 
   10         disciplinary action against licensees of the pest 
   11         control industry under certain circumstances; 
   12         providing that the report may also address additional 
   13         issues of concern to members of the industry; 
   14         providing an effective date. 
   15   
   16  Be It Enacted by the Legislature of the State of Florida: 
   17   
   18         Section 1. The Department of Agriculture and Consumer 
   19  Services shall meet with duly authorized representatives of 
   20  established organizations representing the Florida pest control 
   21  industry and prepare a report that shall be submitted to the 
   22  President of the Senate, the Speaker of the House of 
   23  Representatives, the chairperson of the Senate Committee on 
   24  Agriculture, and the chairperson of the House Committee on 
   25  Agribusiness by January 1, 2011. The report shall include 
   26  recommended amendments to chapter 482, Florida Statutes, which 
   27  provide for disciplinary action to be taken against licensees 
   28  who violate laws or rules pertaining to the pretreatment of soil 
   29  to protect newly constructed homes, pest control at sensitive 
   30  facilities such as schools and nursing homes, and also the 
   31  fumigation of existing homes for protection against termite 
   32  damage, thereby providing additional safeguards for consumers. 
   33  The report may also address other issues of concern to the 
   34  department and to members of the industry, such as changes to 
   35  requirements for professional liability insurance coverage or 
   36  the amount of bond required, duties and responsibilities of a 
   37  certified operator, issuance of a centralized pest control 
   38  service center license, and limited certification for commercial 
   39  wildlife management personnel. 
   40         Section 2. This act shall take effect upon becoming a law.
