ENROLLED 2016 Legislature CS for SB 1288, 1st Engrossed 20161288er 1 2 An act relating to emergency management; amending s. 3 252.34, F.S.; defining the term “activate” for 4 purposes of part I of ch. 252, F.S.; creating s. 5 252.359, F.S.; directing the Division of Emergency 6 Management to create a statewide system to facilitate 7 the transport and distribution of essentials in 8 commerce during a declared emergency; defining the 9 term “essentials”; directing the division to create a 10 certification system for persons transporting or 11 distributing essentials in commerce; providing 12 requirements and conditions for the certification 13 system; permitting certain activities by certified 14 persons during a curfew; authorizing a law enforcement 15 officer to specify a permissible route of ingress or 16 egress for a certified person; amending ss. 163.360, 17 474.2125, and 627.659, F.S.; conforming cross 18 references; providing an effective date. 19 20 Be It Enacted by the Legislature of the State of Florida: 21 22 Section 1. Present subsections (1) through (9) of section 23 252.34, Florida Statutes, are renumbered as subsections (2) 24 through (10), respectively, and a new subsection (1) is added to 25 that section, to read: 26 252.34 Definitions.—As used in this part, the term: 27 (1) “Activate” means the execution and implementation of 28 the necessary plans and activities required to mitigate, respond 29 to, or recover from an emergency or disaster pursuant to this 30 chapter and the state comprehensive emergency management plan. 31 Section 2. Section 252.359, Florida Statutes, is created to 32 read: 33 252.359 Ensuring availability of emergency supplies.— 34 (1) In order to meet the needs of residents affected during 35 a declared emergency and to ensure the continuing economic 36 resilience of communities impacted by disaster, the division 37 shall establish a statewide system to facilitate the transport 38 and distribution of essentials in commerce. 39 (2) As used in this section, the term “essentials” means 40 goods that are consumed or used as a direct result of a declared 41 emergency, or that are consumed or used to preserve, protect, or 42 sustain life, health, safety, or economic well-being. 43 (3) The division shall develop a system to certify each 44 person who facilitates the transport or distribution of 45 essentials in commerce. The division may not certify a person 46 other than a person who routinely transports or distributes 47 essentials. In developing the system, the division: 48 (a) May provide for a preemergency or postemergency 49 declaration certification. 50 (b) Shall allow the certification of an employer, if 51 requested by the employer, to constitute a certification of the 52 employer’s employees. 53 (c) Shall create an easily recognizable indicium of 54 certification to assist local officials’ efforts in determining 55 which persons have been certified under this subsection. 56 (d) Shall limit the duration of each certificate to no more 57 than 1 year. Each certificate may be renewed so long as the 58 criteria for certification are met. 59 (4) A person or employer certified under subsection (3) is 60 not required to obtain any additional certification or fulfill 61 any additional requirement to transport or distribute 62 essentials. 63 (5) Notwithstanding any curfew, a person or employer 64 certified under subsection (3) may enter or remain in the curfew 65 area for the limited purpose of facilitating the transport or 66 distribution of essentials and may provide service that exceeds 67 otherwise applicable hours of service maximums to the extent 68 authorized by a duly executed declaration of a state of 69 emergency. 70 (6) This section does not prohibit a law enforcement 71 officer from specifying the permissible route of ingress or 72 egress for a person certified under subsection (3). 73 Section 3. Subsection (10) of section 163.360, Florida 74 Statutes, is amended to read: 75 163.360 Community redevelopment plans.— 76 (10) Notwithstanding any other provisions of this part, 77 when the governing body certifies that an area is in need of 78 redevelopment or rehabilitation as a result of an emergency 79 under s. 252.34(4)s. 252.34(3), with respect to which the 80 Governor has certified the need for emergency assistance under 81 federal law, that area may be certified as a “blighted area,” 82 and the governing body may approve a community redevelopment 83 plan and community redevelopment with respect to such area 84 without regard to the provisions of this section requiring a 85 general plan for the county or municipality and a public hearing 86 on the community redevelopment. 87 Section 4. Subsection (1) of section 474.2125, Florida 88 Statutes, is amended to read: 89 474.2125 Temporary license.— 90 (1) The board shall adopt rules providing for the issuance 91 of a temporary license to a licensed veterinarian of another 92 state for the purpose of enabling her or him to provide 93 veterinary medical services in this state for the animals of a 94 specific owner or, as may be needed in an emergency as defined 95 in s. 252.34(4)s. 252.34(3), for the animals of multiple 96 owners, provided the applicant would qualify for licensure by 97 endorsement under s. 474.217. No temporary license shall be 98 valid for more than 30 days after its issuance, and no license 99 shall cover more than the treatment of the animals of one owner 100 except in an emergency as defined in s. 252.34(4)s. 252.34(3). 101 After the expiration of 30 days, a new license is required. 102 Section 5. Subsection (4) of section 627.659, Florida 103 Statutes, is amended to read: 104 627.659 Blanket health insurance; eligible groups.—Blanket 105 health insurance is that form of health insurance which covers 106 special groups of individuals as enumerated in one of the 107 following subsections: 108 (4) Under a policy or contract issued in the name of a 109 volunteer fire department, first aid group, local emergency 110 management agency as defined in s. 252.34(6)s. 252.34(5), or 111 other group of first responders as defined in s. 112.1815, which 112 is deemed the policyholder, covering all or any grouping of the 113 members or employees of the policyholder or covering all or any 114 participants in an activity or operation sponsored or supervised 115 by the policyholder. 116 Section 6. This act shall take effect upon becoming a law.
