    2         An act relating to child safety; requiring district
    3         school boards to adopt specified policies; requiring a
    4         person to present picture identification before
    5         retrieving specified students from a public school
    6         under certain circumstances; requiring policies to be
    7         provided to the Department of Education; requiring
    8         nonpublic schools or specified child care facilities
    9         to adopt specified policies; requiring a person to
   10         present picture identification before retrieving
   11         specified students from a nonpublic school or
   12         specified child care facility under certain
   13         circumstances; defining the term “picture
   14         identification”; requiring policies to be maintained
   15         on the premises of each entity and available for
   16         inspection; providing an effective date.
   17          
   18  Be It Enacted by the Legislature of the State of Florida:
   19  
   20         Section 1. No later than July 1, 2018, the school board of
   21  each public school district shall adopt policies that will
   22  ensure that students in prekindergarten through grade 8 in that
   23  school district are not released from the schools to persons who
   24  are not authorized to retrieve them. These policies shall
   25  include a requirement that the person attempting to retrieve the
   26  student, other than at the normal dismissal time, present
   27  picture identification to the school principal or his or her
   28  designee before the student is released to the person. As used
   29  in this section, the term “picture identification” means a valid
   30  state driver license, a valid state identification card, or a
   31  valid United States Military identification card. Copies of the
   32  policies shall be provided to the Department of Education.
   33         Section 2. No later than July 1, 2018, each nonpublic
   34  school exempt from licensure under s. 402.3025, Florida
   35  Statutes, child care facility licensed under s. 402.305, Florida
   36  Statutes, large family child care home licensed under s.
   37  402.3131, Florida Statutes, private school as defined in s.
   38  1002.01, Florida Statutes, and faith-based child care facility
   39  exempt from licensure under s. 402.316, Florida Statutes, shall
   40  adopt policies that will ensure that the children in
   41  prekindergarten through grade 8 in that nonpublic school, child
   42  care facility, large family child care home, private school, or
   43  faith-based child care facility are not released to persons who
   44  are not authorized to retrieve them. These policies shall
   45  include a requirement that the person attempting to retrieve the
   46  child, other than at the normal dismissal time, present picture
   47  identification to the appropriate school or child care official
   48  or his or her designee before the child is released to the
   49  person. As used in this section, the term “picture
   50  identification” means a valid state driver license, a valid
   51  state identification card, or a valid United States Military
   52  identification card. Copies of these policies shall be
   53  maintained on the premises of each entity covered by this
   54  section and be readily available for inspection.
   55         Section 3. This act shall take effect July 1, 2017.
