1 A bill to be entitled
2 An act relating to health insurance coverage for
3 prescription eye drop refills; creating s. 627.6411,
4 F.S.; requiring a health insurance policy that
5 provides coverage for prescription eye drops to
6 provide coverage for renewal eye drops if certain
7 conditions are met; requiring such a policy to provide
8 coverage for one additional bottle of prescription eye
9 drops under certain circumstances; providing that
10 covered prescription eye drop benefits are subject to
11 the same annual deductibles, copayments, or
12 coinsurance established for all other prescription
13 drug benefits under the policy; amending s. 627.662,
14 F.S.; providing applicability of s. 627.6411, F.S., to
15 group health insurance, blanket health insurance, and
16 franchise health insurance; providing an effective
17 date.

19 Be It Enacted by the Legislature of the State of Florida:

21 Section 1. Section 627.6411, Florida Statutes, is created
22 to read:
23 627.6411 Coverage for prescription eye drop refills.—
24 (1) A health insurance policy that provides coverage for
25 prescription eye drops must provide coverage for a renewal of
26 prescription eye drops if all of the following conditions are
27 met:
28 (a) The renewal is requested by the insured:
29 1. For a 30-day supply of eye drops, at least 21 days after
30 the date the original prescription was distributed to the
31 insured or the date the last prescription renewal was
32 distributed to the insured, whichever is later.
33 2. For a 60-day supply of eye drops, at least 42 days after
34 the date the original prescription was distributed to the
35 insured or the date the last prescription renewal was
36 distributed to the insured, whichever is later.
37 3. For a 90-day supply of eye drops, at least 63 days after
38 the date the original prescription was distributed to the
39 insured or the date the last prescription renewal was
40 distributed to the insured, whichever is later.
41 (b) The original prescription states that additional
42 quantities are needed, and the renewal requested by the insured
43 does not exceed such quantities.
44 (2) A health insurance policy that provides coverage for
45 prescription eye drops must provide coverage for one additional
46 bottle of prescription eye drops, limited to every 3 months, if:
47 (a) One additional bottle is requested by the insured or
48 the health care provider at the time the original prescription
49 is filled; and
50 (b) The original prescription states that one additional
51 bottle is needed by the insured for use in a day care center or
52 a school.
53 (3) The prescription eye drop benefits covered under this
54 section are subject to the same annual deductibles, copayments,
55 or coinsurance established for all other prescription drug
56 benefits under the health insurance policy.
57 Section 2. Subsection (16) is added to section 627.662,
58 Florida Statutes, to read:
59 627.662 Other provisions applicable.—The following
60 provisions apply to group health insurance, blanket health
61 insurance, and franchise health insurance:
62 (16) Section 627.6411, relating to coverage for
63 prescription eye drop refills.
64 Section 3. This act shall take effect July 1, 2017.
